道路交通事故损害赔偿法律制度的完善研究

【摘要】：道路交通事故损害赔偿制度，是交通产业秩序关注的重要课题之一。其既涉及道路交通安全的行政制度调整，亦波及交通产业法中路产保护与路权维护的经济法律制度，是经济法学所关注的产业秩序范畴。道路交通事故及其损害赔偿，往往与交通产业的发展伴生。如何在调整交通产业秩序中，规范道路交通事故损害赔偿制度，完善机动车强制责任保险制度，以及社会救助基金制度等，既关乎着受害者的权益保护问题，更影响着交通产业的健康调整与发展问题。本文运用概括分析法和比较研究法，以经济法学的视角，分析道路交通事故损害赔偿制度的秩序问题。着重从机动车强制责任保险中的保险范围、责任限额、第三人直接请求权，以及侵权责任的使用等问题开展比较分析。运用分析方法，就其社会救助基金制度的投资渠道、救助对象、责任范围，以及救助办法问等题进行分析。全文围绕交通产业秩序的规范问题，比较分析道路交通事故中机动车强制责任保险制度、社会救助基金制度等产业秩序规范。在逻辑思路上，沿着提出问题--分析问题--解决问题的思路一气呵成。通过分析道路交通事故损害赔偿制度的秩序，发掘机动车强制责任保险制度、社会救助基金制度存在的秩序问题，从国外比较中获得制度启示。通过总结国内外产业秩序的经验与教训，提出机动车强制责任保险制度和社会救助基金制度的完善构想。提出了交通产业秩序中事故赔偿制度完善的思路与建议。道路交通事故损害赔偿制度的完善，关乎到交通产业的发展、交通产业关系中权益平衡，，以及交通产业秩序的法制问题。
[Abstract]:The system of compensation for road traffic accident damage is one of the most important topics concerned by traffic industry order, which involves the adjustment of administrative system of road traffic safety. It also affects the economic legal system of road property protection and road right maintenance in the traffic industry law, which is the industrial order category concerned by economic law, road traffic accident and its damage compensation. Often associated with the development of traffic industry. How to regulate the order of traffic industry in the regulation of road traffic accident damage compensation system, improve the motor vehicle compulsory liability insurance system, as well as the social relief fund system and so on. It not only concerns the protection of victims' rights and interests, but also affects the health adjustment and development of transportation industry. In this paper, the author uses the general analysis method and the comparative research method to analyze the order of the compensation system of road traffic accident damage from the perspective of economic law, focusing on the scope and limitation of liability in the compulsory liability insurance of motor vehicles. The direct claim of the third party, as well as the use of tort liability to carry out comparative analysis. The use of analytical methods, on its social relief fund system investment channels, relief objects, the scope of responsibility. The paper focuses on the standardization of traffic industry order, and compares and analyzes the compulsory liability insurance system of motor vehicles in road traffic accidents. The system of social assistance funds and other industrial order norms. Logically, along with the problem-analysis-problem-solve the problem in one step. Through the analysis of the order of road traffic accident damage compensation system, explore the motor vehicle compulsory liability insurance system, social assistance fund system of order problems. Through summing up the experience and lessons of industrial order at home and abroad. This paper puts forward the idea of perfecting the system of compulsory liability insurance for motor vehicles and the system of social relief fund, and puts forward some ideas and suggestions on how to perfect the system of accident compensation in the order of traffic industry. The perfection of the system of compensation for road traffic accidents is related to the development of traffic industry, the balance of rights and interests in the relationship of traffic industry, and the legal system of traffic industry order.
