东莞市城市管理综合执法的困境与对策研究

【摘要】：东莞市作为推行相对集中行政处罚权的试点城市之一，经历了超过6年的实践，在一定程度上解决了职能交叉、多头管理的问题，但城市管理综合执法的效果仍然不够理想，多种管理执法事项仍然处于治标不治本的状态。如何才能破解东莞市城市管理综合执法的困局，更好地为推进城市建设、实现美丽中国梦服务，是一个亟待解决的课题。本文以城市管理、行政执法、城管执法、行政综合执法、城市管理综合执法等概念为切入点，先阐述了东莞市城市管理综合执法产生的背景和历史沿革，接着介绍了东莞市作为广东省试点推行城市管理综合执法的机构设置、职能范围与权限、运行模式、管理机制、执法方式和执法成果，然后着重对东莞市城市管理综合执法面临的体制机制方面、权力监督方面和运作保障方面三大困境及原因进行剖析，指出机构设置有缺陷、职能配置不合理、联动机制未理顺，行政自由裁量权偏大、内部和外部监督机制不健全、立法保障不完善、执法保障不完善、司法保障不完善、执法力量薄弱等深层原因；接下来还阐述了香港、新加坡、韩国的城市管理行政执法模式，最后通过分析借鉴，，提出了几点对策建议：一是理顺城市管理综合执法的体制机制，二是加强城市管理综合执法的各项保障，三是完善城市管理综合执法的监督机制，四是创新城市管理综合执法模式，五是建立健全社会保障机制。
[Abstract]:Dongguan, as one of the pilot cities with relatively centralized administrative punishment power, has experienced more than 6 years of practice, to a certain extent, to solve the problem of cross-functional, multi-management. However, the effect of comprehensive urban management law enforcement is still not ideal, a variety of management and law enforcement matters are still in the state of temporary treatment, how to solve the situation of Dongguan city management comprehensive law enforcement. Better for the promotion of urban construction, the realization of beautiful Chinese Dream service, is an urgent task to be solved. Based on the concepts of urban management, administrative law enforcement, urban management law enforcement, urban management comprehensive law enforcement and urban management comprehensive law enforcement, this paper first expounds the background and historical evolution of Dongguan city management comprehensive law enforcement. Then introduced Dongguan as a pilot implementation of comprehensive urban management law enforcement in Guangdong Province, the establishment of institutions, functional scope and authority, operation mode, management mechanism, law enforcement methods and law enforcement results. Then focus on the Dongguan city management comprehensive law enforcement system and mechanism, power supervision and operational security aspects of the three major difficulties and reasons are analyzed, pointing out that there are defects in the establishment of institutions, unreasonable allocation of functions. The linkage mechanism is not straightened out, the administrative discretion is on the large side, the internal and external supervision mechanism is not perfect, the legislative guarantee is not perfect, the law enforcement protection is not perfect, the judicial guarantee is not perfect, the law enforcement force is weak and so on. Then it also expounds the administrative law enforcement mode of urban management in Hong Kong, Singapore and South Korea. Finally, through the analysis and reference, it puts forward several countermeasures and suggestions: first, to rationalize the system and mechanism of comprehensive law enforcement of urban management. The second is to strengthen the various guarantees of comprehensive law enforcement of urban management, the third is to perfect the supervision mechanism of comprehensive law enforcement of urban management, the fourth is to innovate the comprehensive law enforcement mode of urban management, and the fifth is to establish and improve the social security mechanism.
