我国行政奖励法律规制研究

【摘要】:随着我国市场经济的发展、政府职能的转变,政府管理国家与社会事务的方式发生了很大的变化。行政奖励作为政府提高行政效率、引导社会价值、促进社会和谐的一种行政行为应运而生,它具有其他非强制性行政行为所无与伦比的灵活性与优越性,代表了现代行政法治的发展方向。 然而长期以来,,行政法学界并未对行政奖励制度进行深入的研究,而统一立法的缺失更是导致行政奖励存在过多的自由裁量,制度缺陷所导致社会负面效应已经淹没了行政奖励本该具备的激励和引导作用。因此,行政奖励的法制化,不仅是政府的责任,也需要我们广大的法学学者一同努力,将行政奖励带入法制化轨道,用完善、统一的法律制度来规范行政奖励。 正是基于以上考虑,笔者以行政奖励的法律规制作为毕业论文的研究方向。本文由绪论、我国行政奖励存在的问题及原因分析、国外的实践及理论借鉴、行政奖励的法制化等四部分组成。绪论部分,笔者将对选题背景、国内外研究现状以及本文的研究思路进行说明;第二部分,笔者将首先对行政奖励的概念进行重新的界定,明确行政奖励这一非强制性行政行为的概念,而后从实体与程序两个角度探究行政奖励存在的问并对问题产生的原因进行分析;第三部分,笔者将通过对国外的行政奖励实践以及国外行政法治理念发展变化的介绍,从其中找出我国行政奖励可借鉴之处;第四部分,笔者将首先论证完善行政奖励法律规制的必要性,然后从观念、实体、程序三个方面提出完善我国法律规制的对策与建议。
[Abstract]:With the development of our market economy, the transformation of government functions, great changes have taken place in the government management of state and social affairs. The administrative reward for the government to improve administrative efficiency, guide social value, promote social harmony came into being a kind of administrative behavior, it has the incomparable superiority and other non mandatory administrative flexibility that represents the development direction of the modern administrative law.
However, the administrative law scholars did not in-depth study on the system of administrative encouragement, and lack of uniform legislation resulted in more administrative incentives exist discretion the institutional defects lead to negative effects of social administrative reward has been inundated with the encouragement and guidance. Therefore, the legalization of administrative encouragement. Not only is the responsibility of the government, we also need the majority of legal scholars will work together, into the orbit of the legal system of administrative encouragement, with perfect legal system to regulate the unified administrative reward.
Based on the above considerations, the legal regulation of administrative reward as the research direction of the graduation thesis. This paper consists of introduction, analysis of existing problems and causes of China's administrative incentives, from theory and practice abroad, the administrative encouragement legal system is composed of four parts. The introduction part, the author discusses the background, research at home and abroad present situation and ideas of this research are explained; the second part, the author will first the concept of the administrative reward re definition, clear concept of administrative reward the non mandatory administrative act, and then from the two aspects of entity and procedure of administrative reward problems and analyze the causes of the problem; the third part, the author based on the practice of the foreign administrative incentives and changes of foreign administrative law concept, from which to find our administrative reward can be used for reference; the fourth part, The author will first demonstrate the necessity of perfecting the legal regulation of administrative encouragement, and then put forward three countermeasures and suggestions to improve our legal regulation from the perspectives of concept, entity and procedure.
