宏观调控权的行政法规制研究

【摘要】:宏观调控是我国应对市场经济周期波动的重要工具,宏观调控权是国家和政府调节经济的权力,其中既包括中央和地方在宏观调控中的关系,也包括了中央政府层面的宏观调控权力的分配问题。本文主要运用比较分析法、历史研究法、实证分析法等研究方法,从如下几个方面对宏观调控权的行政法规制进行研究。文章第一部分阐述了宏观调控权行政法规制的基本理论。首先,厘清什么是规制和什么是行政法规制,理清两者关系是本文进行研究的基础性任务。其次,从宏观调控权的内涵、外延及特点,论证了对宏观调控权行政法规制的必要性。最后,以宏观调控权行政法规制的发展历程为主线,从市场失灵的大前提入手,对宏观调控的基本概念、发展历程及其合法性、正当性基础作了较为详实的论述。文章第二部分是宏观调控权行政法规制的基本原则。宏观调控权行政法规制的基本原则是指根据宪法和行政法相关制度,将宏观调控权的的设立、运行及责任救济置于法律的调配之下,以免权力被破坏和滥用的具有普适性的一般性准则。在社会主义市场经济大环境下,国家介入市场竞争已成为必然趋势,但是介入的限度和手段上,行政法规制作为国家公权力介入的代表,占据着重要地位,在行政法规制中,既包括宏观调控权特有的权力制约原则,也包括行政法自身的基本原则,如由我国根本政治制度决定的合法行政原则、适用于裁量性行政活动的合理行政原则、以行政公开等为主要内容的程序正当原则、由有权必有责决定的权责统一原则等。文章第三部分是宏观调控权的行政法规制方式。从时间上,传统规制方式和现代新兴规制方式,到境内域外的比较分析。介绍了我国宏观调控行政法规制的领域以及常见的规制手段,再选取了美国和法国两个国家作为典型代表,对比分析了大陆法系和英美法系下行政规制的不同特点以取长补短,期望对我国的行政法规制有所裨益。文章第四部分是宏观调控权的法律监督与救济机制,本章作为全文的核心章节之一,是对前述宏观调控行政法规制现状和困境的回应,包括宏观调控权的法律监督制度、宏观调控权的救济路径与宏观调控权的责任形式三个部分。从突破传统行政法藩篱入手,责任形式分了三个部分,分别为行为人的责任形式,包括行政问责、引咎辞职、行政处分;财产的责任形式,包括国家赔偿、恢复原状状;其他责任形式,主要是变更或撤销行政决策等作为兜底,全方位入手,阐明宏观调控权不当行使的的多种责任形式。宏观调控权的法律监督包括立法监督、司法监督、行政机关内部监督与公众监督等。宏观调控权的法律救济路径,是宏观调控权致损的防线。要实现行政法律救济,首要解决的就是宏观调控权的可诉性问题,本文在肯定了宏观调控权可诉的基础上,展开了对宏观调控权法律救济路径的探讨。可通过违宪审查制度、行政公益诉讼、行政复议、国家赔偿等多元化路径得到应有的救济,希望以此建立健全我国宏观调控行政法规制的机制体制,保障我国社会主义市场经济的繁荣、稳定发展。
[Abstract]:Macro control is an important tool of economic cycle fluctuation in China to cope with the market, the macro-control power of state and government regulation of economic power, which includes not only the relationship between the central and local government in macroeconomic regulation, including the distribution of the macro-control power of the central government level. This paper mainly uses the method of comparative analysis, historical research method. The research methods of empirical analysis, conducts the research from the administrative regulation of the macro-control power as follows. The first part expounds the basic theory of the macro-control power regulation of administrative law. First of all, to clarify what is what is the regulation and regulation of administrative law, clarify the relationship between the two sides is the basic task of the study in this paper. Secondly, from the connotation of the macro-control power, the extension and the characteristics, demonstrates the necessity of the macro-control power administrative regulation. Finally, with the macro-control power regulation of administrative law development process The main line, starting from the premise of the market failure and the basic concept of macro-control, the development process and its legitimacy, the legitimacy of the basis for a more detailed discussion. The second part is the basic principle of macro-control power regulation of administrative law. The macro-control power regulation of administrative law basic principle refers to the constitutional and administrative law the relevant system, the macro-control power will set up under the operation and relief of the law responsibility allocation, so as not to have general guidelines for universal destruction and abuse of power. In socialist market economy environment, the state intervention in the market competition has become an inevitable trend, but the intervention limits and means, on behalf of the executive law as the state power to intervene, occupies an important position, in the regulation of administrative law, including the principle of restricting the specific macro-control power power, including the basic principles of administrative law itself Then, as determined by the fundamental political system of our country legal administrative principle, reasonable administrative principle applies to the discretion of administrative activities, administrative procedures to the public as the main content of the legitimate principle, by responsibility decision responsibility unified principle. The third part is the way of macro regulation and control of the right of administrative law from the time, the traditional way of regulation and modern new regulation, to comparative analysis of foreign territory. This paper introduces the field of China's macro-control regulation of administrative law and common means of regulation, and then selected the United States and France two countries as a typical representative, comparative analysis of the different characteristics of administrative regulation under the civil law and common law to learn from each other, will benefit the regulation of administrative law in our country. The fourth part is the legal supervision and relief mechanism of macro-control power, this chapter is one of the core of the whole, Is the macro-control administrative regulation of current situation and predicament of response, including macroeconomic regulation of the legal supervision system, the macro-control power relief path with the macro-control power responsibility form three parts. Starting from the breakthrough of the traditional administrative law barriers, liability form is divided into three parts, respectively is the responsibility of people who form, including administrative accountability, resignation, administrative punishment; property liability, including state compensation, restitution; other forms of responsibility, is mainly the change or cancellation of administrative decision as a fallback, full range of macro-control, clarify the improper exercise of the right to various forms of responsibility. The legal supervision of the macro-control power including legislation supervision, judicial supervision, administrative internal supervision and public supervision. The macro-control legal relief path, is the macro-control power loss caused by the defense. In order to realize the administrative legal relief priority Is the justiciability of macro-control power, based on the affirmation of macro-control right to appeal on the discussion of macro-control rights of legal relief path. Through judicial review, administrative litigation, administrative reconsideration, state compensation and other diversified route due to relief, hoping to establish a mechanism perfecting the macro-control regulation of administrative law system, the protection of China's socialist market economy prosperity, stability and development.
