我国影视拍摄活动的环境保护立法完善研究

【摘要】：发展经济和保护环境,是社会发展过程中一对看似对立实则相互促进的两个重要命题。一味追求经济的发展容易破坏生态环境,而只顾保护环境又可能会限制经济的发展速度,若在经济发展过程中注重合理利用自然资源,保护生态环境,兼顾经济利益和环境利益,则可以促进社会的可持续健康发展。影视行业作为近代以来迅速发展的新兴产业,已经成为国家经济发展进程中的产业支柱之一,在影视拍摄过程中注重保护拍摄地的生态环境,不仅可以促进影视业的绿色发展,也能很好带动拍摄地经济的发展。实际上,近年来剧组破坏拍摄地环境的事件频频发生,引起了社会公众的不满。而影视拍摄活动破坏环境事件的发生并非偶然,反映的正是我国环境法制存在弊端。因此,为了保护拍摄地的环境,完善相关法律法规,促进影视业的健康发展,本文以影视拍摄活动的环境保护立法为研究视角,以期通过修订我国相关法律规定,更好地完善影视拍摄活动中政府的监管职责,规制拍摄剧组的拍摄行为。全文分为五个部分。第一部分为绪论,主要介绍影视拍摄的环境保护立法这一命题的研究背景、研究意义,本文的研究内容和方法等;第二部分分别从影视拍摄的施工期、拍摄期、拍摄结束期这三个阶段分析拍摄行为对拍摄地土壤、水体、野生动植物、大气等环境要素造成的不利影响;第三部分则是先分析我国目前关于影视拍摄活动的环境保护这一问题的立法现状,再从立法现状中发现存在的不足之处;第四部分是主要是从我国发生的一系列“剧组环境门事件”、完善现行环境法和促进影视业绿色发展这几个方面分析完善影视拍摄的环境保护立法的必要性,从影视拍摄剧组的社会责任、国内外关于影视拍摄行为的环境保护现状两方面论述进行影视拍摄的环境保护立法的可行性;第五部分就是在前四个部分内容的基础上,针对立法中存在的不足提出完善建议,主要有践行环境保护优先的环境法基本原则、细化行政主管部门的监管职责、修订和完善《环境影响评价法》、完善相关法律责任制度。
[Abstract]:Developing the economy and protecting the environment are two important propositions in the process of social development which seem to be opposite and mutually promote each other. It is easy to destroy the ecological environment by blindly pursuing the economic development, but only to protect the environment may limit the speed of economic development. If we pay attention to the rational use of natural resources, protect the ecological environment and take into account the economic and environmental interests in the process of economic development, we can promote the sustainable and healthy development of society. It has become one of the industry pillars in the process of national economic development. Paying attention to protecting the ecological environment of the shooting sites during the filming process can not only promote the green development of the film and television industry, but also promote the development of the local economy. In fact, In recent years, the incidents that the crew destroyed the environment of the scene occurred frequently, which caused the public dissatisfaction. However, the occurrence of the environmental events of the film and television filming activities is not accidental, which reflects the malpractice of the environmental legal system in our country. In order to protect the environment of the shooting site, perfect the relevant laws and regulations, and promote the healthy development of the film and television industry, this paper takes the environmental protection legislation of the film and television shooting activities as the research angle, with a view to revising the relevant laws and regulations of our country. The thesis is divided into five parts. The first part is the introduction, which mainly introduces the background of the proposition of environmental protection legislation. The significance of the study, the research content and methods of this paper. The second part analyzes the impact of filming behavior on the soil, water, wildlife and so on. The third part is to analyze the current situation of legislation on the environmental protection of film and television shooting activities in China, and then to find the shortcomings from the current situation of the legislation. The 4th part mainly analyzes the necessity of perfecting the environmental protection legislation of film and television shooting from a series of "environmental events" in China, perfecting the current environmental law and promoting the green development of the film and television industry. This paper discusses the feasibility of environmental protection legislation for film and television shooting from the social responsibility of film and television crew and the current situation of environmental protection of film and television shooting behavior at home and abroad. Part 5th is based on the first four parts. In view of the shortcomings in the legislation, some suggestions are put forward, such as carrying out the basic principle of environmental protection priority, refining the supervision responsibility of the administrative department, revising and perfecting the Environmental impact Assessment Law, and perfecting the related legal liability system.
