论环境民事侵权案件适用惩罚性赔偿的可能与限度

【摘要】：在环境民事侵权审判领域是否引入惩罚性赔偿制度已成为一个热点话题。惩罚性赔偿制度的威慑功能与惩罚功能与环境法的本质特征高度契合,能很好地填充补偿性赔偿制度的功能缺失。大规模环境侵权案件的频发、当前环境侵权救济制度的困境以及我国已有的惩罚性赔偿制度的立法及司法实践是环境民事侵权领域适用惩罚性赔偿制度的现实基础。因此,在环境民事侵权领域适用惩罚性赔偿具有可能性。适用惩罚性赔偿的关键在于赔偿数额的确定,在"过罚相适应"原则的指引下,应适当考虑侵权人的主观过错程度、补偿性赔偿数额、侵权人的获利情况以及侵权人的经济状况等因素。
[Abstract]:Whether to introduce punitive damages into the field of environmental tort trial has become a hot topic. The deterrent function and punishment function of punitive damages system are highly consistent with the essential characteristics of environmental law. It can fill the function of compensatory compensation system very well. The frequent occurrence of large-scale environmental tort cases, The current plight of the environmental tort relief system and the legislation and judicial practice of the existing punitive damages system in China are the realistic basis for the application of the punitive damages system in the field of environmental civil tort. It is possible to apply punitive damages in the field of environmental civil tort. The key to the application of punitive damages lies in the determination of the amount of compensation. Under the guidance of the principle of "excessive punishment", due consideration should be given to the degree of subjective fault of the infringer. The amount of compensatory compensation, the profit of the infringer and the economic condition of the infringer.
