论公民文化权的保护——以权能范畴为视角

【摘要】：目前,我国对于文化利益的保障还处于初级阶段,之于公民文化权利还没有建立起完善的、行之有效的保护机制。立法体系的不完备和较弱的保护力度,严重影响到了民事主体的文化利益的实现。因此,在国家层面,针对明确的文化权利内容和切实的保护需求,我们应当以现有的权利保障资源为起点,找寻本国文化权利保护的缺陷与不足。而以建立完善的文化权利保障体系为目标,则有助于我们为文化权利的保护设计阶段性的方案,并由此总结出相对合理的改革建议。
[Abstract]:At present, the protection of cultural interests in our country is still in the primary stage, and there has not been a perfect and effective protection mechanism for the cultural rights of citizens. It seriously affects the realization of the cultural interests of civil subjects. Therefore, at the national level, in response to the clear content of cultural rights and practical protection needs, we should start with existing resources for safeguarding rights, To find out the defects and shortcomings of the protection of cultural rights in our country, and to set up a perfect system of safeguarding cultural rights is helpful for us to design a phased scheme for the protection of cultural rights, and to sum up the relatively reasonable suggestions for reform.
