安县:法治的异化——县域法治的个案研究

【摘要】：县域法治是国家法治的基础。通过个案调研发现,县域经济社会快速发展的同时,法治的异化却在加深,并带来县域中政府主导型发展牺牲法律规则、干部任命集权化导致群体性腐败、政商合作中权钱交易常态化、干部政治伦理恶化造成法律疏离化、关系人伦下的规则变通、社会市场化扭曲法律等法治困境。破解法治异化的出路在人民主体性复归,加强民主建设,实现民主和法治的良性互动。
[Abstract]:The county rule of law is the foundation of the country's rule of law. Through case investigation, it is found that while the county economy and society are developing rapidly, the alienation of the rule of law is deepening, and leading to the government's leading development in the county at the expense of the legal rules. Centralization of cadre appointment leads to mass corruption, regularization of power and money transactions in cooperation between government and business, deterioration of political ethics of cadres resulting in legal alienation, flexibility of rules related to human relations, The way to break the alienation of the rule of law lies in the return of the people's subjectivity, the strengthening of the democratic construction, and the realization of the benign interaction between democracy and the rule of law.
