“城中村”旧宅基地退出与流转路径选择

【摘要】：由于受到城乡二元土地管理结构的限制,目前一些城市在城中村改造中,对旧宅基地的退出与流转模式始终没有跳出"一宅两制"的制度限制,包括宅基地置换等模式,依然具有"被征收""被退出与流转"的性质。因此,文章以渐进的形式构建一种通过宅基地入股到宅基地信托制,并最终建立复合型所有制形式的城中村旧宅基地退出与流转路径,将对"城中村"旧宅基地的改造利用具有十分重要的借鉴价值。
[Abstract]:Because of the restriction of urban and rural dual land management structure, at present, some cities have not jumped out of the system of "one house and two systems" in the transformation of urban villages, including the replacement of housing sites. It still has the nature of "being expropriated" and "being withdrawn and transferred". And the final establishment of the compound form of ownership of the old urban village homestead exit and circulation path will be "village in the city" of the old homestead transformation and utilization of a very important reference value.
