网络语言暴力的法律规制

【摘要】：随着信息技术的飞速发展,互联网日益普及,人类社会已经进入信息化时代,网络成为人们日常工作、生活不可或缺的一部分,网络超越地域的界限将世界各地的人们都联系在一起,使处于地球两端的人也可以通过网络进行实时交流。网络的产生和发展改变了人们的生活方式,人与人之间的交流、获取外界信息越来越多的依赖于网络,网络为人们的生活带来了极大的便利,为人们的交流提供了自由、广阔的平台,同时也大大提高了生活和工作的效率。近些年,随着互联网在我国大范围的发展普及,网络已经深入到普通人民的日常生活,我国互联网的使用人数连年攀升。然而网络在给人们带来极大积极利益的同时,也随之带来了许多意想不到的消极影响,网络语言暴力现象泛滥是目前我国互联网发展过程中一个比较严重的问题,其直接扰乱了网络秩序,也间接的威胁着现实社会的正常秩序,更有可能侵犯某些网络参与者的合法权益。网络语言暴力现象在我国有愈演愈烈的趋势,起初只是在有较大争议的问题上,不同观点的持有者会因激烈的争论引发骂战,而现在暴力的语言在网络中几乎随处可见,一点点观点的差异都会有或多或少,或轻或重的暴力语言伴随其中。在2013年年中,则以“袁姗姗滚出娱乐圈”为标题的新闻在各大网站首页持续出现,网络媒体在对这一事件发生的原因进行总结时,其中一条原因是没有原因,也许这就是网络语言暴力的可怕之处。在互联网为国家发展、人们生活带来极大利益的前提下,我们不能任由网络发展过程中产生的消极影响吞噬其积极作用,网络语言暴力带来了极大的危害,为了维护互联网的健康发展,实现网络的积极作用,必须采取措施控制网络语言暴力事件的蔓延,使用法律手段调整网络语言暴力现象。我国宪法赋予了公民言论自由的权利,公民可以按照自己的意愿自由的发表言论以及听取他人陈述意见。在网络社会,言论自由同样受到法律保护,甚至被鼓励,网络为言论自由拓宽了渠道和方式,也激发了人们在网络中自由发声的热情,就网络舆论监督角度而言,公民充分行使言论自由权利是值得鼓励的。但是任何权利的行使都是有限度的,合理行使权利必须不能妨碍他人正常行使权利,因此公民在行使言论自由权利时也不是毫无限度可言的,尤其是在虚拟的网络社会中,超出限度的行使言论自由权利极易导致网络语言暴力现象的产生。在规制网络语言暴力现象时,必须准确把握言论自由权利的限度。对于网络语言暴力的概念,并没有完全一致的标准,本文在搜集整理各类相关论文,了解分析具体的网络语言暴力事件的基础上,加上个人的见解,对网络语言暴力分别从其语义,表现形式对其内涵做了介绍,再结合前人的一些研究成果,笔者对网络语言暴力做了法律角度的定义：网络语言暴力是不特定数量的网民群体利用互联网的隐蔽性,在参与网络交流中对某一事件的特定对象,通过语言霸权的形式发表侮辱性、攻击性的言论,对他人的心理或精神造成伤害的违法行为。为了进一步了解网络语言暴力现象,本文接下来分析了网络语言暴力的特征,网络语言暴力的特征不同于现实社会中出现的传统暴力,其特征与网络自身的一些特点不可分离。对网络语言暴力进行法律规制必须对网络语言暴力现象进行全方位的充分了解,因此归纳网络语言暴力现象产生的原因及后果也是必不可少的,只有找到原因才能对症下药,看到危害后果才能积极采取预防措施。在对网络语言暴力现象全方位的分析后,为了获得更具有可行性的规制措施,我们可以了解其他国家对于这一问题的应对策略,从而去其糟粕,取其精华,以我国网络语言暴力的现状为基础,揭示网络语言暴力的本质,找寻法律规制的突破口。最后,在前文分析总结的基础上,探讨了规制网络语言暴力的法律途径。本文运用实证研究方法,展开对网络语言暴力的法律规制的研究,以达到控制暴力语言的肆意蔓延的意旨。本文以提出问题、分析问题、解决问题的思路,从网络语言暴力的概念出发,归纳网络语言暴力的特征、成因及后果,指出网络语言暴力行为的接受法律规制的必要性,然后吸取其他国家对于这一问题的应对策略,从法律的角度找到规制的突破口,分析网络语言暴力的违法性及接受法律规制的可能性。经过分析,本文认为网络语言暴力背后存在价值冲突,违反基本法律原则,与现代法治精神相背离,从而必须从整合价值冲突,确定网络中的行为必须符合法律的基本原则,并确立有关具体的法律制度,此外从司法和执法层面完善相关制度措施,在合理的限度内控制网络语言暴力,让虚拟的网络社会和现实社会一样,有章可循、有法可依,营造和谐的网络环境。
