我国公务用车的法律规制研究

【摘要】：随着我国经济的快速发展,财政收入不断提高,各级政府在公务用车配置上出现了超编制、超标准、公车私用等诸多现象。我国现行的公务用车使用制度是在计划经济时期发展出来的,与我国现行的社会主义市场经济体制发生了巨大冲突,腐败滋生、国有资产流失、铺上浪费等问题充斥在公车的配置、使用过程中,这些问题不仅影响了政府的公众形象,更成为阻碍社会发展的不稳定因素。因此,公务用车制度改革势在必行。公务用车制度的改革和完善不仅可以有效控制行政成本、提高办事效率,还可以树立阳光透明的政府形象。通过公车制度的改革,推动公务用车的法律完善,使公车的采购、使用、管理等过程逐步走向规范化、法制化,让公车使用有法可依、有章可循。我国目前的公务用车制度还存有大量缺陷,本文将对公务用车制度及法律规制的相关理论进行分析,并提出一些完善的建议。
[Abstract]:With the rapid development of China's economy and the continuous improvement of financial revenue, governments at all levels have exceeded the establishment and standards in the allocation of official vehicles. The current system for the use of official vehicles in our country was developed during the planned economy period, resulting in a huge conflict with the current socialist market economic system of our country, corruption breeding, loss of state-owned assets, In the process of using, these problems not only affect the public image of the government, but also become an unstable factor that hinders the development of the society. Therefore, the reform of the official vehicle system is imperative. The reform and perfection of the official vehicle system can not only effectively control the administrative cost, improve the work efficiency, but also set up a sunny and transparent government image. The processes of use and management are gradually moving towards standardization and legalization, so that there are laws to follow and rules to follow in the use of public cars. There are still a lot of defects in the current system of official vehicles in our country. This paper analyzes the relevant theories of the system of official vehicles and legal regulations, and puts forward some perfect suggestions.
