公民在突发事件信息传播中的地位与责任探析

【摘要】：我国多部法律对于公民在突发事件中的信息传播问题作出明确规定。这些法律规定在对公民编造、传播虚假信息的追责等方面高度一致,且规定了明确的法律责任与后果,但在"信息报告"与"信息举报、检举和监督"的性质上表述不一,出现了权利与义务迥异的现象。对于公民过失传播突发事件失实信息的追责原则,应严格遵循厘清事实、区分传播者权能、保持法律的谦抑性等原则,同时应将公民的信息报告纳入道德责任范畴,避免在司法实践中出现法律义务与法律责任严重失衡的情形。
[Abstract]:China's laws for the problem of information communication in the event of citizens to make specific provisions. These provisions of the law on civil fictions, dissemination of false information and other aspects of accountability is highly consistent, and the provisions of legal liability and the consequences of clear, but in the "information" and "information reporting, the nature of prosecution and supervision" the expression of a the rights and obligations of different phenomena. For the citizens of fault propagation emergency untrue information of responsibility principle, should strictly follow the clear facts, distinguish the disseminator of power, maintain modesty principle of law, and should report the information of citizens into the moral responsibility category, avoid legal obligations and legal the responsibility of serious imbalance happened in the judicial practice.
