【摘要】：我国城市化速度越来越快,伴随着农村拆迁,城市密度增加,拆迁中丢弃宠物的事情越来越多,流浪动物遍布城市每个角落。无人管理的流浪动物繁育毫无节制,数量激增,因此可能会带来流浪动物伤人,狂犬病传播,虐待动物等等一系列的社会问题。从目前来看我国动物相关立法很不全面,对于动物的立法依旧停留在预防疾病传播和食品安全等方面。随着保护动物意识的增强和动物保护理论的发展,动物福利立法日益受到重视。大多数发达国家都有动物福利立法,包括我国香港和台湾地区很早就制定了动物保护法。近几年我国内地学者也开始重视相关理论的研究,并起草了《反虐待动物法》专家意见稿,《动物保护法》专家意见稿等相关立法著作,希望引起相关部门的重视。动物保护理论的成熟会有助于相关法律的建立和完善。近些年动物保护问题在社会上引起了广泛的关注和激烈的讨论,归根结底在于我国对动物保护不够重视,相关立法欠缺,各种动物在法律上的细分不明确,且政府部门权利分管不明,遇见问题互相推诿。相关立法迄待完善。因此,唯有改变现有观念,建立动物保护相关立法,树立尊重动物生命的法律观念,才能使动物与人类和谐共处,达成人与自然和谐的社会目标。本文一共分为五章,引言主要阐述文章的研究目的动机、研究方法、研究范围和研究架构的说明。第一章主要介绍本文的研究价值,动物保护运动的蓬勃发展推动了流浪动物保护理论的发展和相关立法的制定。另一方面我国流浪动物问题的产生与相关立法的缺失息息相关。因此完善相关立法对于解决我国流浪动物问题尤为重要。第二章是本文研究的理论基础,主要探讨动物在法律中的地位,以及流浪动物归属权等问题。通过从法理上阐述流浪动物保护意义,为流浪动物保护立法提供法理依据。第三章对我国相关法律制度的缺陷进行分析。因为相关立法缺失才会使流浪动物问题难以纳入政府工作计划,又使民间救助陷入两难境地。也因立法的缺失才会导致部门权责划分不清,政府对流浪动物的管理治标不治本。第四章是流浪动物立法比较研究。因为动物保护立法在很多国家都已经发展的相对完备,很多经验方法对我国相关立法制定都有借鉴作用。第五章乃论文对相关立法之拙见,提出流浪动物问题解决的方法,建议在条件具备时制定《流浪动物保护法》,并探讨现阶段我国相关立法有待完善之处。
[Abstract]:China is becoming more and more urbanized. With the rural demolition, the density of cities increases, there are more and more pets abandoned in the demolition, and stray animals are scattered around every corner of the city. As a result, it may bring about a series of social problems such as the wounding of stray animals, the spread of rabies, the mistreatment of animals, and so on. At present, the relevant legislation on animals in our country is not comprehensive. Animal legislation remains focused on preventing the spread of disease and food safety. With the increasing awareness of animal protection and the development of animal protection theory, Animal welfare legislation is receiving increasing attention. Most developed countries have animal welfare legislation, including the early enactment of animal protection laws in Hong Kong and Taiwan. In recent years, mainland scholars in China have also begun to attach importance to the study of relevant theories. And has drafted the expert opinion draft of the Anti-maltreatment of Animals Law, the expert opinion draft of the Animal Protection Law, and other relevant legislative works, I hope to attract the attention of relevant departments. The maturity of animal protection theory will contribute to the establishment and improvement of relevant laws. In recent years, animal protection has aroused widespread concern and heated discussion in society. In the final analysis, we do not pay enough attention to animal protection, lack of relevant legislation, various animals in the legal subdivision is not clear, and the rights of government departments are not clear, the problems encountered by each other prevarication. The relevant legislation has yet to be improved. Only by changing the existing concept, establishing the relevant legislation of animal protection, establishing the legal concept of respecting animal life, can animals and human beings live in harmony and achieve the social goal of harmony between man and nature. This paper is divided into five chapters. The introduction mainly describes the motivation, methods, scope and framework of the research. Chapter one mainly introduces the research value of this paper. The vigorous development of animal protection movement has promoted the development of the theory of the protection of stray animals and the formulation of relevant legislation. On the other hand, the emergence of the problem of stray animals in China is closely related to the lack of relevant legislation. The second chapter is the theoretical basis of this paper. This paper mainly discusses the status of animals in the law, as well as the rights of belonging to stray animals. The third chapter analyzes the defects of the relevant legal system of our country, because the lack of relevant legislation will make it difficult for the problem of stray animals to be included in the government's work plan. It also makes civil assistance in a dilemma. It is also because of the lack of legislation that the division of powers and responsibilities between departments is not clear. Chapter 4th is a comparative study of legislation on stray animals. Because animal protection legislation has developed relatively well in many countries, Many experience and methods can be used for reference in the formulation of relevant legislation in our country. Chapter 5th is the paper's humble opinion on the relevant legislation, and puts forward the methods to solve the problem of stray animals. It is suggested that the vagrant animal protection law should be formulated when the conditions are available, and the relevant legislation in our country should be improved at the present stage.
