中央与地方立法权关系视角下的网约车立法——基于《立法法》与《行政许可法》的分析

【摘要】:2016年下半年大量出台的中央和地方网约车立法的法制基础问题引发学界热议,而中央与地方行政许可权划分的诠释视角则诚值关注。作为网约车规制核心立法的《暂行办法》,其自身的法律依据并不稳固,其中的部分条款也存在违背《行政许可法》和《立法法》之嫌。作为部门规章的身份,也导致其难以成为地方网约车立法的适格授权主体。即便有《暂行办法》的授权,地方网约车立法在行政许可设定依据和权限上的瑕疵也无法修复。而基于法律原则体系之观察,则凸显了网约车立法具体规范设计方面的诸多疑义。未来,应当在强化中央立法原则性控制、反思文件治理模式、改革央地立法权配置的基础上,促进自上而下的传统规制策略向上下并举新思路的转变,最终实现网约车规制体系的优化与完善。
[Abstract]:In 2016, a large number of central and local legislation on the legal basis of ride-sharing legislation triggered a heated debate in academic circles. However, the angle of view of the division between central and local administrative permission is concerned. As a temporary measure of the core legislation of ride-sharing regulation, its own legal basis is not firm. Some of its provisions also violate the Administrative Licensing Law and the Legislative Law. Their status as departmental regulations also makes it difficult for them to become the subject of appropriate authorization for local ride-sharing legislation. Even if there is an authorization for "interim measures", The defects of the local legislation on the establishment of administrative license and the limits of authority can not be repaired, and the observation based on the system of legal principles highlights many doubts about the specific specifications and design aspects of the legislation. In the future, On the basis of strengthening the central legislative principle control, reflecting on the management mode of documents and reforming the allocation of legislative power in central and local areas, we should promote the transformation of the traditional regulation strategy from top to bottom to a new way of thinking at the same time. Finally, we can optimize and perfect the regulation system.
