福建平潭自贸园区劳动合同法律制度的区际冲突及其解决途径

【摘要】:2014年12月28日,第十二届全国人民代表大会常务委员会第十二次会议把平潭列入新一轮自由贸易区建设试点。平潭贸易园区依据上海自贸实验区,结合平潭地方特点,在充实新的试点内容的基础上建立。2015年4月21日,中国(福建)自由贸易试验区平潭片区正式挂牌成立。随着平潭自贸园区的正式挂牌成立,大陆与台湾海峡两岸的未来交往将会更加便捷和频繁,也将会有越来越多的台籍员工来到平潭自贸园区就业,也将会有越来越多的台籍企业选址平潭建设企业。相关劳动者和用人单位在签订劳动合同或从事劳动的过程中必然会发生一些冲突,在解决冲突时必然会面临着适用法律的选择问题。由于大陆和台湾的历史、政治等原因,大陆和台湾分属不同的法域,两地区的法律存在着明显的不同,因此这必然会导致法律适用上的冲突。这就会牵涉到区际法律冲突的相关问题。为了合法、合理和公平公正的解决涉台劳动纠纷,切实保护海峡两岸当事人的正当权益,促进海峡两岸关系的长远发展,探讨涉台劳动关系的法律适用问题是一个十分重要而紧迫的课题。我们不仅要制定解决海峡两岸关系法律冲突的法律适用法(涉台区际冲突法),更要制定规范涉台劳动关系的实体法,从而使海峡两岸的发展更加规范化和法制化。目前理论界关于我国区际法律冲突、海峡两岸经济合作的研究已经取得了很大的突破,但这些研究主要是围绕着区际法律冲突的一般问题和平潭综合实验区的发展、社会组织的建设、一般立法等方面,而针对平潭地区劳动法律冲突的研究还是少之又少。本文共分六大部分。第一部分是绪论部分,这一部分主要介绍了本选题的研究背景、研究意义、国内外的研究现状和本选题研究的重点、难点与创新之处以及本文的研究方法;第二部分则主要是分析了我国福建平潭自贸园区的特殊性,本部分主要是从马克思主义的联系、发展和矛盾的辩证关系理论方面分析福建平潭自贸园区的普遍性与特殊性,重点介绍了福建平潭自贸园区的特殊性;第三部分则是重点介绍了中国区际法律冲突的相关理论与实践,因为福建平潭自贸园区主要是对台商贸往来,所以本部分主要是从涉台区际法律冲突的角度讨论我国区际法律冲突产生的条件、特殊性和解决原则与途径,以及涉台区际法律冲突的实践;第四部分介绍了福建平潭自贸园区中劳动法律适用所存在的问题,主要介绍了通过劳动合同所确立的劳动关系法律适用中大陆与台湾的不同;第五部分是本文所要解决的问题,也是本文最重要的一部分,是笔者在前文对福建平潭自贸园区的中国区际法律冲突的相关理论与实践的介绍的基础上,针对福建平潭自贸园区这一特殊区域的特殊区际法律冲突所提出的些许设想。
[Abstract]:In December 28th 2014, at the 12th meeting of the standing Committee of the 12th National people's Congress, Pingtan was included in the pilot project of a new round of free trade zones. Established on the basis of enriching the new pilot content. In April 21st 2015, the Pingtan District of China (Fujian) Free Trade pilot area was officially established. With the establishment of the formal listing of the Pingtan Free Trade Park, The future exchanges between the mainland and the two sides of the Taiwan Strait will be more convenient and frequent, and more and more Taiwanese employees will come to the Pingtan Free Trade Park for employment. There will also be a growing number of Taiwanese enterprises choosing sites for Pingtan construction enterprises. There will inevitably be some conflicts between the relevant workers and the employing units in the process of signing labor contracts or engaging in labor. In resolving the conflict, the choice of applicable law will inevitably be faced. Due to the historical and political reasons of the mainland and Taiwan, the mainland and Taiwan belong to different jurisdictions, and there are obvious differences in the laws of the two regions. Therefore, this will inevitably lead to conflicts in the application of laws. This will involve issues related to conflicts of laws between regions. In order to legally, reasonably and fairly resolve labor disputes involving Taiwan, and effectively protect the legitimate rights and interests of the parties on both sides of the Taiwan Strait, To promote the long-term development of cross-strait relations, It is a very important and urgent issue to discuss the application of laws concerning labor relations in Taiwan. We not only need to formulate the applicable law to resolve the conflict of laws between the two sides of the Taiwan Strait (the conflict of laws between the two sides of the Taiwan Strait is concerned), but also to formulate the norms for the conflict of laws between the two sides of the Taiwan Strait. Substantive Law on Labor Relations in Taiwan, As a result, the development of the two sides of the Taiwan Strait has become more standardized and legalized. At present, the research on economic cooperation between the two sides of the Taiwan Strait has made a great breakthrough in the theoretical circle on the conflict of laws between the regions of our country. However, these studies mainly focus on the general problems of inter-regional conflict of laws and the development of Pingtan comprehensive experimental area, the construction of social organizations, the general legislation, and so on. However, the research on the conflict of labor laws in Pingtan area is still very few. This paper is divided into six parts. The first part is the introduction part, which mainly introduces the research background and significance of this topic. The current situation of domestic and foreign research, the key points of this topic, the difficulties and innovations, and the research methods of this paper. The second part mainly analyzes the particularity of Pingtan Free Trade Park in Fujian Province, this part is mainly from the Marxist connection. The dialectical relation theory of development and contradiction analyzes the universality and particularity of Fujian Pingtan Free Trade Park, focusing on the particularity of Fujian Pingtan Free Trade Park. The third part focuses on the relevant theory and practice of the conflict of laws between regions in China, because the Fujian Pingtan Free Trade Park mainly deals with Taiwan. Therefore, this part mainly discusses the conditions, particularities, principles and approaches of the conflict of laws between the regions concerned with Taiwan from the angle of the conflict of laws between the regions concerned with Taiwan, as well as the practice of the conflicts of laws between the regions concerned with Taiwan. Part 4th introduces the problems existing in the application of labor laws in Pingtan Free Trade Park, Fujian Province, and mainly introduces the differences between mainland China and Taiwan in the application of labor relations laws established through labor contracts. Part 5th is the problem to be solved in this paper. It is also the most important part of this paper. It is based on the introduction of the theory and practice of the conflict of laws between the Chinese regions in Pingtan Free Trade Park, Fujian Province. This paper puts forward some tentative ideas on the conflict of laws in this special region of Pingtan Free Trade Park in Fujian Province.
