我国转基因食品安全法律制度研究

【摘要】:随着生物技术的快速发展,转基因食品已经开始慢慢走进人们的生活,随之而产生的必然是对转基因食品安全性的关注。在食品安全问题越来越受到人们关注的今天,转基因食品的商业化就更加受到人们的关注。转基因食品安全性特征不同于普通的传统食品,其具有危害潜在性、安全标准不确定性、致害范围的广泛性和后果的严重性、法律保障的特殊性等特征。在不可否认全球对于转基因食品需求性的同时,各国政府及国际组织必须依靠构建有效的转基因食品法律制度体系来保障本国的转基因食品安全。在食品领域对转基因技术的需要是我国现实国情所决定的现实需求,随着转基因食品逐步推向市场,其安全性问题成为各国政府和民众最为关心的问题。在我国的转基因食品安全立法中究竟是采用欧盟的“风险预防原则”还是采用美国的“无罪推定原则”,这一方面取决于我们的文化传统和民众对转基因食品的认知度、我国目前的生物技术水平等因素,另一方面也即更为重要的一方面就是法律制度的保障。本文先从转基因食品的定义和内涵着手,然后详细地从监管制度、标识制度等方面简介了欧盟、美国、日本等国家和地区的转基因食品安全的立法实践,在对我国目前的转基因食品安全立法进行了简要的介绍和分析后,指出了我国现有转基因食品安全立法的不足。在分析了我国转基因食品安全立法完善的必要性后,本文对我国的转基因食品安全立法在借鉴他国经验和结合我国国情的基础上,从我国转基因食品安全风险评估制度、转基因食品安全标签制度、转基因食品安全监督管理制度、转基因食品安全的救济制度等法律制度的完善方面对我国的转基因食品安全立法提出了几点不成熟的建议。
[Abstract]:With the rapid development of biotechnology, genetically modified food has begun to slowly into people's lives, the attendant is to concern about the safety of genetically modified food. The food safety problem more and more attention today, the commercialization of genetically modified food. People pay more attention to the safety of genetically modified food features different from ordinary the traditional food, which has potential hazards, safety standard uncertainty, severity and consequences of the damage caused by the wide range of features, such as special legal protection. In denying the global transgenic food demand at the same time, governments and international organizations must rely on building an effective legal system of genetically modified food to protect the safety of genetically modified food. In the field of food needs of transgenic technology is decided by the practical needs of the actual situation in our country, with the turn based Because of the food market gradually, its security issues become the most concern to the government and people of all countries. In our country the genetically modified food safety legislation in the EU is the "precautionary principle" or "the principle of presumption of innocence", on the one hand, depends on our culture and public awareness of genetically modified food, factors of China's current bio technology level, on the other hand, the more important aspect is the protection of the legal system. This paper starts from the definition and connotation of genetically modified food to proceed, then detail the supervision system, identification system and other aspects of the European Union, the United States, Japan and other countries and regions. Genetically modified food safety legislation in our country, the safety of genetically modified food legislation is introduced and analyzed briefly, pointed out that China's existing genetically modified food safety legislation The defect of the method. In the analysis of the necessity of perfecting the legislation of genetically modified food safety in China, this article on China's genetically modified food safety legislation based on the experience of other countries and combining with China's national conditions, from the evaluation system of genetically modified food safety risk in our country, the safety of genetically modified food labeling system, supervision and management system of genetically modified food safety, improve the safety of genetically modified food relief system of the legal system of our country's legislation of genetically modified food safety and puts forward some suggestions for improvement.
