【摘要】：种子是农业生产必备的生产资料,特别是在经济全球化进程步伐加快,各国日益将抢占国际种子市场上优势地位作为新一轮国际竞争制高点的形势下,必须引起高度重视。本研究选取我国农业种子产业政策法律问题为切入点,对其进行体系构建以此规范种子产业发展,试图为有关部门制定种子产业发展政策提供参考性建议,推动种子产业走向现代化、国际化。本研究主体内容主要涉及五个部分：一是基础理论研究。基于国内外研究,对我国农业种子产业政策法律问题的基本理论进行剖析,如“产业政策与产业政策法”、产业政策的“影响因素、价值功能”,再利用法学、经济法学的基础理论,从市场规制理论、宏观调控理论、利益与利益机制理论、可持续发展理论、公共品理论、产业安全理论、市场失灵与政府失灵理论入手进行剖析。二是农业种子产业政策法律问题的现状考量。对我国东部、中部、西部等典型地区的农业种子产业发展展开调研,剖析我国农业种子产业发展现状,梳理国内现有种子产业法律法规、规范性文件等,挖掘种子产业政策存在主要法律问题,从利益协调性、主体局限性、区域配置性、监督环节、制度保障等因素着手分析原因。三是国外借鉴分析部分。选取国外农业种子产业政策发展较好的国家,如美国、法国、波兰、印度进行介绍,借鉴有利经验为我国种业可持续健康发展提供参考。四是我国农业种子产业政策制定与完善部分。以突出重点、协调发展、企业主体、公平竞争等为基本原则,探索我国农业种子产业政策的基本架构,在草拟《农作物种子产业发展政策》草案基础上,针对产业政策的关键内容种质资源管理,草拟《种质资源管理办法实施细则》。五是法律运行保障部分。为我国农业种子产业政策发展提供政策与法律支持,并完善农业种子产业政策主体法律制度、科技创新制度、市场准入制度、监督管理制度、风险防控等制度,建立一系列保障其良好运行的机制及激励机制,保障我国农业种子产业发展政策能够有效实施。全面且具体化对种子产业发展政策、法律、法规进行详细梳理与构建。根据种子产业政策所涉及的主要内容、产业链维度、产业政策维度构建三维立体空间,对农业种子产业政策结构进行架构；根据架构体系框架,草拟我国农业种子产业发展政策；针对整个种子产业发展的内容,考虑种质资源保护是其中重要部分,草拟我国农作物种质资源管理办法实施细则。总之,本研究期望能通过对种子产业政策的构建以及其法律保障的系统化分析,探讨当前农业种子产业应该如何规范,种子产业政策体系如何架构；力度通过论证引起有关部门对我国种子产业发展政策的制定、种质资源保护的重视,为农业种子可持续健康发展提供引导和规范；为有关部门提供制定种子产业政策提供框架思路。同时,也期望本研究所草拟出的农作物种质资源管理办法实施细则能为以后种质资源保护提供新的参考。
[Abstract]:The seed is the essential means of production of agricultural production, especially in accelerating the pace of economic globalization, countries increasingly will seize the international seed market advantage as a new round of international competition situation, we must attach great importance to. This research selects China's agricultural seed industry policy and law as the starting point, carries on the construction in order to regulate the development of seed industry system, trying to provide reference for relevant departments to formulate policies to promote the development of seed industry, seed industry modernization, internationalization.
The main content of this paper mainly includes five parts: one is the basic theory research. Based on the research at home and abroad, analyzes the basic theory of the legal problems of agricultural seed industry policy in our country, such as "industrial policy and industrial policy law", the influence factors of industrial policy ", the value function, the basic theory of economic law.
