中国军事法治的发展路径

【摘要】：中国真正形成自己的军事法治和军事法学,需要经历三大重构工程:一是对中国的军事法律传统进行重构与创新,二是对西方军事法律理念和军事法律制度进行重构与创新,三是对中国的军事法律现实进行重构与创新。这种重构是指在深度反思、具体辨析和整体把握的基础上,对古今中外的军事法律义理、军事法律制度和军事法律文化进行筛选、加工、升华和整合,从而形成中国的军事法治模式和军事法学理论。
[Abstract]:In order to form its own military rule of law and military jurisprudence, China needs to undergo three major reconstruction projects: one is to reconstruct and innovate China's military legal tradition, the other is to reconstruct and innovate the western military legal concepts and systems. The third is to reconstruct and innovate the reality of military law in China. This kind of reconstruction refers to the screening of military legal justice, military legal system and military legal culture in ancient, modern and foreign countries on the basis of deep reflection, concrete analysis and overall grasp. Processing, sublimation and integration, thus forming China's military rule of law model and military jurisprudence theory.
