公安机关人民警察执法权益保护研究

【摘要】：长期以来,警察这个整体作为国家机器,在社会生活和公众心目中都是一种强势的形象,人们比较关注的是警察在执法中个人行为的合法性,重视警察在执法过程中对公民权益的维护,相对缺少对警察执法权益以及执法过程中人身安全保护的重视。在实践中,公安民警的执法权益屡屡遭到侵害,人身安全受到挑战和危害,暴力抗法,袭警,诬告陷害等事件时有发生,公安民警执法权益被削弱和弱化,严重地矮化了国家机器的权威,对公安队伍的士气和工作积极性也有消极的影响。积极地保护公安民警的执法权益不受侵害,对于依法治国,建设和谐社会具有重要的现实意义。
[Abstract]:For a long time, the whole of the police, as a state machine, is a strong image in the social life and in the eyes of the public. People are more concerned about the legitimacy of the individual behavior of the police in enforcing the law. Attention should be paid to the protection of the civil rights and interests of the police in the course of enforcing the law, and the relative lack of attention to the rights and interests of the police and the protection of their personal safety in the course of law enforcement. In practice, the rights and interests of the police in enforcing the law have been repeatedly violated. Personal safety has been challenged and endangered. Incidents such as violent resistance to the law, attacks on police officers, and false accusations against the police occur from time to time. The rights and interests of the public security police in enforcing the law are weakened and weakened, seriously dwarfing the authority of the state machinery. It has a negative effect on the morale and work enthusiasm of the public security forces. It is of great practical significance to protect the law enforcement rights and interests of the police from being infringed on and to govern the country according to law and to build a harmonious society.
