公共资源统一交易之法律空间与实现途径

【摘要】：建立统一规范的公共资源交易平台是当前全国各地落实十八届三中全会提出的"推进公共资源配置市场化"与"加快转变政府职能"要求的火热实践,其本身应是在现行法律框架下运用自由裁量权和发挥行政指导等现代行政手段作用的制度规制,行政机关却采用了过往公共资源交易实践中惯用的设置公共资源交易管理委员会、强制入场交易等不当制度设计,明显有偏法治轨道,纠正这种偏误的可行方式是采取行政规制规范公共资源统一交易。
[Abstract]:The establishment of a unified and standardized public resource trading platform is a hot practice in implementing the requirements of "promoting marketization of public resource allocation" and "speeding up the transformation of government functions" put forward by the third Plenary session of the 18 Central Committee in various parts of the country. In itself, it should be the system regulation of using discretion and giving play to the functions of modern administrative means, such as administrative guidance, under the current legal framework. However, the executive authorities have adopted improper system designs such as setting up the Public Resources Trading Management Committee and mandatory admission transactions, which are used in the practice of public resources trading in the past. Obviously, there is a biased track towards the rule of law. The feasible way to correct this error is to adopt administrative regulation to regulate the unified transaction of public resources.
