经济适用房购买指标转让协议的效力探讨

【摘要】:经济适用住房是政府为保障低收入住房困难家庭的居住权益而提供的安居保障工程,但在实践中,一些人却受利益驱动,无视经济适用住房的社会保障性质,而以经济适用房购买指标为标的物进行交易,由此引发诸多纠纷。由于无论是法律、行政法规还是国务院部门规章、地方政府规章都未对经济适用房购买指标转让问题作出明确规定,因此法院在处理经济适用房购买指标转让纠纷时作出的判决结果并不一致。 本文对各地法院审理经济适用房购买指标转让纠纷所作出的判决进行了梳理归纳,总结出法院判定经济适用房购买指标转让协议效力的主要理由,并在归纳总结的基础上对法院的有效判定进行了反思,通过对转让协议所涉公私利益的发现与衡量,将探讨着眼于法院处理经济适用房购买指标转让协议的效力问题。除引言外,本文主要分为以下六个部分: 第一部分,分析了我国司法实践中法院对经济适用房购买指标转让的认定。指出了对于经济适用房购买指标转让问题我国立法上的空白以及司法中的混乱认定,概括了法院判定经济适用房购买指标转让协议效力的主要理由,并分析了法院对经济适用房购买指标转让协议作出有效判定时思路上存在的问题。 第二部分,界定了经济适用房购买指标的法律属性。区分了容易与经济适用房购买指标相混淆的住宅权、行政许可以及行政给付等概念,并分析得出经济适用房购买指标是债权的结论。 第三部分,介绍了判定合同效力的一般理论。合同当事人具备相应的民事行为能力、意思表示真实且合同内容不违反法律或者社会公共利益是合同得以生效的一般要件。但有效的合同不仅要具有合法性,同时还要符合社会妥当性的要求。 第四部分,对经济适用房购买指标转让协议是否违法进行了分析。在介绍了判断合同是否违法的一般理论后,对转让经济适用房购买指标与转让购买不满五年的经济适用房、转让预售商品房进行了区分。得出的结论是,转让经济适用房购买指标在性质上属于债权转让,具有合法性。 第五部分,,对经济适用房购买指标转让协议是否损害社会公共利益进行了分析。具备合法性的合同未必就当然有效,其还要接受社会公共利益的最终审查。转让经济适用房购买指标虽然是指标享有人的合同自由,但合同当事人行使其自由的行为,违背了《经济适用住房管理办法》平衡社会利益分配、减小贫富差距、保障低收入住房困难家庭居住权益的立法目的。 第六部分,对实践中的经济适用房购买指标转让纠纷作出了类型化的分析。在指标受让人符合经济适用住房申购条件的情况下,指标出让人转让指标的行为没有影响经济适用住房制度发挥其保障低收入住房困难家庭居住权益的作用,因此,对于该类转让中合同当事人的私人利益,法律应当予以保护;在指标受让人不符合经济适用住房申购条件的情况下,指标转让行为不仅违背了《经济适用住房管理办法》平衡社会利益分配、促进社会公平的立法目的,而且还加剧了贫富差距,不利于政府对低收入人群的保障,因此,对于此类转让中指标出让人的合同自由与指标受让人的信赖利益,法律不应予以保护。
[Abstract]:Affordable housing is housing security project in the government to protect the housing difficulties of low-income families living rights provided, but in practice, some people are driven by interests, ignoring the nature of social security housing, and affordable housing purchase index for the subject matter in the transaction, which caused many disputes because. Whether the laws, administrative regulations or the State Council regulations, local government regulations are not on the affordable housing purchase index transfer to make specific provisions, the court in dealing with affordable housing purchase index transfer disputes verdict is not consistent.
This paper made over the court affordable housing purchase index transfer dispute decision summarized, summed up the main reason for the court to purchase affordable housing index transfer agreement, and summarized on the basis of effective judgment on the court was reviewed, by involving the public and private interests of the transfer agreement and discovery the validity of the measure, the court focuses on affordable housing purchase index of the transfer agreement. In addition to the introduction, this paper is mainly divided into the following six parts:
The first part, analysis of China's judicial practice in the courts of affordable housing purchase index transfer. The paper points out that the affordable housing purchase index transfer problem of blank in legislation and judicial confusion in identification, summarizes the court to determine the affordable housing purchase index the main reason for the effectiveness of the transfer agreement, and analyzes the the court judge thought on the problems of affordable housing purchase index transfer agreement.
The second part defines the legal attribute of the purchase index of affordable housing. It distinguishes the concepts of housing right, administrative license and administrative benefit which are easy to be confused with the index of affordable housing purchase, and concludes that the index of the purchase of affordable housing is the conclusion of creditor's rights.
The third part introduces the general theory to determine the validity of contract. The parties to the contract have corresponding capacity for civil conduct, the true meaning and content of the contract does not violate the law or the public interest is the general conditions of contract validity. But the effective contract not only has the legitimacy, but also meet the requirements of social appropriateness.
The fourth part of the affordable housing purchase index transfer agreement is illegal is analyzed. In introduces general theory of determining whether the contract law, the transfer of affordable housing purchase index and purchase of less than five years of affordable housing, the transfer of the pre-sale of commercial housing were distinguished. The conclusion is that the transfer of affordable housing the purchase index in the nature of the assignment of creditor's rights, it is legal.
The fifth part of the affordable housing purchase index transfer agreement does harm the public interests are analyzed. With the legitimacy of the contract is not certainly effective, but also accept the final review of the public interest. The transfer of affordable housing purchase index is the index to enjoy the freedom of contract, but the contract parties to exercise their freedom of behavior. Contrary to the "measures on the management of affordable housing to balance the distribution of social interests, reducing the gap between rich and poor, guarantee the legislative purpose of housing rights and interests of low-income housing for needy families.
The sixth part makes a typological analysis of the practice of affordable housing purchase index transfer disputes. In the index of the transferee in accordance with the purchase of affordable housing conditions, the transferor transfer behavior index index did not affect the economic applicable housing system to play its protection of housing rights and interests of low-income housing for needy families, therefore, for the transfer contract of the party in the private interests, the law should be protected; the index transferee does not comply with the purchase of affordable housing conditions, the transfer behavior not only violates the "index measures on the management of affordable housing to balance the distribution of social interests, promoting the legislation purpose of social justice, but also exacerbated the gap between the rich and the poor, is not conducive to the government guarantee for low-income people so, for such a transfer refers to the freedom of contract and the index marked so that the transferee of the trust interest method Law should not be protected.
