【摘要】：目前我国食品安全事故频发,屡禁不止,政府虽然加强了惩治力度,但成果依旧不太明显。本文是在《食品安全法(修订草案送审稿)》审议的过程中以及大部制改革对食品安全监管部门的整合的基础下写作的。本文主要以食品安全监管为研究对象,通过行政法律责任理论,探寻食品安全监管方面的行政法律责任,通过研究行政法律责任的追究现状,反思其在现有制度层面上存在的问题,结合食品安全监管实际,提出完善意见,目的在于通过行政法律责任制度的完善促进食品安全行政法律责任追究效率的提高,从而为解决我国食品安全屡禁不止的现象找到新的突破口。论文的第一章主要论述食品安全监管行政法律责任理论基础。首先,对食品安全的相关概念进行辨析。其次,主要论述了食品安全的监管标准。最后论述了食品安全监管的行政法律责任理论。论文的第二章主要论述了我国食品安全监管行政法律责任的现状,介绍了我国食品安全监管不力的现状、行政法律责任追究的现状,分析了监管不力的原因是行政法律责任追究机制的不完善,总结出我国食品安全监管行政法律责任方面的问题。论文的第三章主要讲述了美国、欧盟、日本食品安全监管的立法规定、监管现状及行政法律责任追究情况,通过对国外的食品安全监管的了解,总结经验和启示。论文的第四章主要论述了我国食品安全监管行政法律责任追究机制的完善是解决食品安全问题的关键,对行政法律责任追究机制的完善做了具体构想。论文的结语,主要论述行政法律责任追究机制的完善是解决食品安全监管不力的根本原因,完善行政法律责任制度能对食品安全屡禁不止起到遏制作用。
[Abstract]:At present, food safety accidents occur frequently in our country and are not prohibited. Although the government has strengthened its punishment, However, the results are still not obvious. This paper is written on the basis of the review of the Food Safety Law (revised draft) and the integration of the food safety supervision department by the reform of the Ministry of Food Safety. This paper is mainly written on the basis of food safety. Full supervision is the object of study. Through the theory of administrative legal responsibility, this paper explores the administrative legal responsibility of food safety supervision, through the study of the status quo of administrative legal responsibility, reflects on its existing problems in the existing system, and combines the actual situation of food safety supervision. The purpose of this paper is to improve the efficiency of the investigation of food safety administrative legal liability through the perfection of administrative legal liability system, and to find a new breakthrough for solving the phenomenon of repeated prohibition of food safety in our country. The first chapter mainly discusses the theoretical basis of the administrative legal responsibility of food safety supervision. First, the related concepts of food safety are analyzed. This paper mainly discusses the supervision standard of food safety, and finally discusses the theory of administrative legal responsibility of food safety supervision. The second chapter mainly discusses the current situation of the administrative legal responsibility of the food safety supervision in China, introduces the current situation of the inadequate food safety supervision in China, the current situation of the investigation of the administrative legal responsibility. This paper analyzes the reasons of the weak supervision is the imperfection of the investigation mechanism of the administrative legal responsibility, and summarizes the problems in the administrative legal liability of the food safety supervision in our country. The third chapter mainly describes the legislation of food safety supervision in the United States, the European Union and Japan, the current situation of supervision and the investigation of administrative legal liability, through the understanding of foreign food safety supervision, summed up the experience and inspiration. Chapter 4th of the paper mainly discusses the perfection of the mechanism of the investigation of the administrative legal responsibility for food safety supervision in China is the key to solve the problem of food safety, and makes a concrete conception on the perfection of the mechanism of the investigation of the administrative legal responsibility. The conclusion of the paper mainly discusses that the perfection of the investigation mechanism of administrative legal responsibility is the fundamental reason to solve the weak supervision of food safety. Perfecting the system of administrative legal responsibility can restrain food safety from repeated prohibitions.
