论未成年人人身安全的法律保护

【摘要】：未成年人的人身安全始终是一个被延续讨论的话题，在现代社会中对未成年人人身安全的保护也变得越来越重要。人身安全，从广义的范围上来说就是大家都了解的生命、人格和名誉等方面的安全；从法律的角度上来说，主要讨论刑法上的人身安全，是指人的人身自由权、性自由权等权利的安全，也就是说，是人作为一个整体、身体上的安全，身体受自己支配的自由，身体不受侵犯的权利，未成年人的人身安全亦是如此。笔者尝试从近期发生的一个校园性侵案件中，分析社会上对未成年人人身安全侵害的现状，围绕着现实需要，尝试去完善我国的法律，特别是刑法上对未成年人人身安全保障的理论研究，并力图以不同的角度去研究侵犯未成年人人身安全的犯罪，探讨新的制度保护，为保护未成年人的人身安全作出努力。本文分为三章。第一章，笔者引用了2013年发生的真实案例，通过分析案例，探讨案例中出现的疑惑，进一步引出本文所要研究的问题，即未成年人人身安全频遭侵害问题，并尝试分析未成年人人身安全频受侵害的原因，从四个方面进行说明；第二章，笔者选择从具体的保护未成年人人身安全的犯罪立法入手，主要是分析我国刑法对未成年人人身安全保护的现状，指出存在的问题，并根据存在的问题提出完善的建议；第三章，笔者试着探讨了法律以外的保护制度，希望能建立与保护未成年人人身安全的相关配套制度，从而加强对其人身安全的保护。
[Abstract]:The personal safety of minors has always been a subject of continuous discussion. In modern society, the protection of minors' personal safety has become increasingly important. Personal security, in a broad sense, is the life that everyone knows. From the legal point of view, the main discussion on personal security in criminal law refers to the security of human rights, such as the right to personal liberty, the right to freedom of sex, and so on, that is, the safety of the human being as a whole and of his body. The freedom of the body to be subject to its own control, the right to inviolability of the body, as well as the safety of the minor. The author tries to analyze the current situation of social violation of minors' personal safety from a recent sexual assault case on campus, and try to perfect the laws of our country around the actual needs. Especially the theoretical research on the protection of the personal safety of minors in criminal law, and try to study the crime of infringing upon the personal safety of minors from different angles, explore the new system of protection, and make efforts to protect the personal safety of minors. This paper is divided into three chapters. In the first chapter, the author cites the real case that occurred in 2013, through the analysis of the case, discusses the confusion in the case, and further leads to the problem that this paper will study, that is, the frequent violation of the minor's personal safety. And try to analyze the reasons for the frequent violation of minors' personal safety, and explain from four aspects. Chapter two, the author chooses to start with the specific criminal legislation to protect the personal safety of minors. It mainly analyzes the present situation of the protection of minors' personal safety in the criminal law of our country, points out the existing problems, and puts forward some perfect suggestions according to the existing problems. Chapter three, the author tries to discuss the protection system outside the law. It is hoped that the relevant supporting system for the protection of minors' personal safety can be established, thereby strengthening the protection of their personal safety.
