填海造地项目“海变地”换证制度研究

【摘要】：自改革开放以来,我国沿海各省市的社会、经济长期快速发展,人口增长压力日益增加,导致了土地资源、空间资源短缺的矛盾越来越突出。因此,沿海地区大量实施填海造地项目。时至今日,填海造地项目大多完成了“填”的过程,丧失了原有的海洋属性,原海域使用权属人需要将手中的海域使用权证变更为土地使用权证。我国《海域使用管理法》等法律法规,在一定程度上规范了填海造地行为,但制度建设依然不够完善,缺乏具有可操作性的换证流程。各地从自身利益出发,制订地方性法规,从而导致“海变地”管理制度五花八门,造成海域使用权人为获得土地使用权所付出的成本差别巨大。本文针对我国填海造地项目在海域使用权与土地使用权变更环节中存在的问题以及管理制度的缺陷,以保障海域使用权人利益为出发点。从解析《海域使用管理法》和《物权法》等法律制度和海域使用权性质入手,基于海洋与陆地综合规划、协调发展的需要,通过对国内外相关海域管理制度及我国土地管理法律制度发展过程的调研和对比分析,规范微观控制制度,改革“海变地”的管理模式,进一步强化海域管理与土地管理的制度衔接,力求实现填海造地项目海域使用权与土地使用权的顺利过渡。“海变地”管理制度的改革创新也是当前我国加强海岸带管理的必然要求,对实现江、河、湖、海等国家资源的一体化管理具有重要的参考意义。
[Abstract]:Since the reform and opening up, the society and economy of coastal provinces and cities in China have developed rapidly for a long time, and the pressure of population growth is increasing day by day, which leads to the contradiction of land resources and space resources shortage becoming more and more prominent. A large number of land reclamation projects have been implemented in coastal areas. Up to now, most of the reclamation projects have completed the process of "reclamation" and have lost their original oceanic properties. The original sea area use right belongs to the person who needs to change the sea area use right certificate into the land use right certificate. To a certain extent, the land reclamation behavior is regulated by the laws and regulations such as the Law on the use and Management of Sea area in China, but the system construction is still not perfect. Lack of an operational process for changing certificates. All localities, proceeding from their own interests, formulate local laws and regulations, resulting in a variety of management systems for "sea to land", This paper aims at the problems existing in the process of land reclamation projects in our country and the defects of the management system in the process of changing the right to use the sea area and land use right, which is caused by the huge difference in the cost of obtaining the right to use the land by the users of the right to use the sea area. Based on the analysis of the legal system and the nature of the right to use the sea area, based on the needs of the comprehensive planning of the sea and land, and the need of coordinated development, the paper starts with the protection of the interests of the persons using the right to use the sea area. Through the investigation and comparative analysis of the development process of the relevant sea area management system at home and abroad and the legal system of land management in our country, the microcosmic control system is standardized and the management mode of "sea to land" is reformed. To further strengthen the link between sea area management and land management, In order to realize the smooth transition of land use right and land use right of reclamation project, the reform and innovation of the management system of "sea land change" is also the inevitable requirement of strengthening coastal zone management in our country at present, and it is necessary to realize rivers, rivers and lakes. The integrated management of resources in sea and other countries has important reference significance.
