【摘要】：行政规范性文件作为我国法律、法规、规章等的重要补充，不仅是我国国家机关合法合理行政的依据，也是广大公民维护自身合法权益的重要保障，在我国的政治经济生活和社会生活中发挥着举足轻重的作用。但是因为制定主体的多样化以及素质水平参差不齐等原因，导致制定的行政规范性文件也是五花八门。国家层面上又缺乏统一的规定，这导致行政规范性文件出现了一系列问题，如下级行政规范性文件违反上级法规规章，同级行政规范性文件内容相冲突等等，导致国家机关及公民在适用行政规范性文件时无所适从。本文以行政规范性文件的备案审查为视角，采用实证分析的方法，对行政规范性文件备案审查的理论问题进行了梳理，对其在社会生活中的现状、存在的问题进行了全面分析，对完善行政规范性文件的备案审查提出了思考。本文分为引言、正文、结语和后记四个部分，其中正文包括四章：第一部分，行政规范性文件备案审查制度概述。首先，分别明确了行政规范性文件和行政规范性文件备案审查的概念，，并分析了备案与审查的关系。其次，分析说明了行政规范性文件备案审查制度的意义。最后，从理论方面阐释了行政规范性文件备案审查的依据。第二部分，对行政规范性文件备案审查制度于其他法律制度的关系进行了分析。首先，对行政规范性文件备案审查制度与违宪审查制度、清理制度做了比较分析，分析他们之间的联系与区别。其次，对备案审查制度与行政复议制度和行政诉讼制度的关系进行了探讨。第三部分，行政规范性文件备案审查制度的现状分析。首先从内容不明确、标准不统一等方面对行政规范性文件备案审查的问题进行了阐述，然后分别从思想认识、制度缺陷和机构设置等方面对其进行了原因分析。第四部分，完善行政规范性文件备案审查制度的思考。分别从完善实体上与程序上的规定进行了思考，还从建立相关配套制度方面提出了完善行政规范性文件备案审查制度的措施。
[Abstract]:As an important supplement to the laws, regulations and rules of our country, administrative normative documents are not only the basis for the legitimate and reasonable administration of our state organs, but also an important guarantee for the broad masses of citizens to safeguard their legitimate rights and interests.In our country's political and economic life and social life plays a pivotal role.However, due to the diversity of the subject and the level of quality, the administrative normative documents are also varied.There is also a lack of uniform regulations at the national level, which leads to a series of problems in administrative normative documents, such as the following administrative normative documents violate the rules and regulations of higher levels, the contents of administrative normative documents at the same level conflict with each other, etc.As a result, state organs and citizens are at a loss when applying administrative normative documents.From the perspective of filing and examination of administrative normative documents, this paper, by means of empirical analysis, combs the theoretical problems of administrative normative documents' archival review, and makes a comprehensive analysis of its present situation and existing problems in social life.The paper puts forward some thoughts on how to improve the filing and examination of administrative normative documents.This paper is divided into four parts: introduction, text, conclusion and postscript, in which the text consists of four chapters:The first part is an overview of the system of filing and examining administrative normative documents.Firstly, the concepts of administrative normative documents and administrative normative documents are defined, and the relationship between filing and examination is analyzed.Secondly, it explains the significance of administrative normative documents filing and examination system.Finally, it explains the basis of administrative normative document record examination from the theory aspect.The second part analyzes the relationship between administrative normative documents filing and examination system and other legal systems.First of all, the paper makes a comparative analysis of the administrative normative document record examination system and the unconstitutional review system, and analyzes the relationship and difference between them.Secondly, the relationship between the record-keeping review system, the administrative review system and the administrative litigation system is discussed.The third part is the analysis of the current situation of administrative normative documents filing and examination system.At first, the paper expounds the problems of administrative normative documents filing and examining from the aspects of unclear content and inconsistent standards, and then analyzes the reasons from the aspects of ideological understanding, institutional defects and institutional setting.The fourth part, consummates the administrative normative document to put on record the examination system ponder.From the aspects of perfecting the substantive and procedural provisions, this paper also puts forward some measures to perfect the administrative normative documents filing and examination system.
