【摘要】：随着转基因生物技术的飞速发展,转基因食品国际贸易在全球食品国际贸易总额中所占的比例也逐年增大。出于对贸易自由和环境安全的不同考量,WTO、《生物多样性公约》等国际多边型协议在转基因食品的议题上有很大的差异和冲突。本文以理论结合实践的方式对转基因食品国际多边型协议进行梳理,分析其中存在的冲突之处,并结合相关司法实践就冲突矛盾的协调解决做一构想。在此基础上结合我国转基因食品法律规制现状,对我国转基因食品安全监管立法提出建议。本文除引言和结论外分为五个部分。第一部分介绍了全球转基因食品,转基因生物技术,转基因生物产品等相关概念和当前转基因食品行业的发展现状等基本情况,以转基因食品可能引发的问题为切入点,对转基因食品法律规制的重要作用进行了阐述。第二部分将目前与转基因食品有密切联系的国际多边型协议分为WTO、《生物多样性公约》和其他国际组织文件协议三个框架,梳理了现有的转基因食品国际法律规制,从国际法层面上阐述了转基因食品的监管现状。第三部分围绕WTO与《生物多样性公约》关于转基因食品国际法律规制不同规定的冲突,从冲突的产生原因、表现形式、造成的影响等方面对当前转基因食品国际法律规制在适用中存在的矛盾进行了阐释和判断。第四部分分析了解决转基因食品国际法律规制冲突中存在的难点问题,对如何协调转基因食品国际法律规制之间的冲突提出了构想和思路。第五部分对我国转基因食品安全立法现状作了介绍,结合转基因食品国际法律规制的启发,对我国转基因食品法律规制提出了建议和应对措施。
[Abstract]:With the rapid development of genetically modified biotechnology, the proportion of international trade of genetically modified foods in the total international trade of global food is increasing year by year.Due to different considerations of trade freedom and environmental security, there are great differences and conflicts on the issue of genetically modified foods in international multilateral agreements such as the Convention on Biological Diversity.In this paper, the author combs the international multilateral agreements on genetically modified foods by combining theory with practice, analyzes the conflicts existing in them, and makes a conceive on the coordinated resolution of conflicts in combination with relevant judicial practice.On the basis of this, the author puts forward some suggestions on the legislation of the safety supervision of transgenic food in our country according to the present situation of the legal regulation of transgenic food in our country.In addition to the introduction and conclusions, this paper is divided into five parts.The first part introduces the global GM food, GMO technology, GMO products and other related concepts, and the current development of the GMF industry, and so on, starting with the possible problems caused by GMFs as a starting point.The important role of legal regulation of genetically modified food was expounded.The second part divides the international multilateral agreements which are closely related to genetically modified foods into three frameworks: WTO, the Convention on Biological Diversity and the documents of other international organizations, and combs the existing international legal regulation of genetically modified foods.From the level of international law, this paper expounds the current situation of the regulation of genetically modified food (GMF).The third part focuses on the conflict between WTO and the Convention on Biological Diversity on the international legal regulation of genetically modified food, from the causes and manifestations of the conflict.The influence of GMF on the application of the current international legal regulation of GM food has been explained and judged.The fourth part analyzes the difficult problems in solving the conflict of international legal regulation of genetically modified food, and puts forward some ideas and ideas on how to coordinate the conflict between international legal regulation of genetically modified food.The fifth part introduces the current situation of the legislation on the safety of genetically modified food in China. Combined with the inspiration of international legal regulation of genetically modified food, the author puts forward some suggestions and countermeasures for the legal regulation of genetically modified food in China.
