农村集体土地发展权权利属性之探究

【摘要】:土地是人类赖以生存的最重要资源,是一切生产和一切存在的源泉①。自古以来,关于土地的开发及利用,等等制度构建和运行,便始终与社会安宁及发展紧紧相连,同时与社会的兴衰和人民的福祉息息相关②。随着城市化进程的快速推进和社会主义市场经济体制的逐步建立,我国的土地制度也在不断深入发展。从早期的农村承包经营与国有土地有偿使用到城镇国有土地使用权出让、转让,再到现在的土地征收、集体建设用地使用权流转等等都表现出我国在土地发展过程中,对土地产权的界定不断明晰深化。改革开放的纵深发展,人们对权利意识逐步增强,关于土地发展权问题的研究也更加深入。然而,现行的土地制度很难解决实践中出现的社会问题。且我国正处于城镇化快速推进的关键时期,与此同时,耕地资源和农村集体土地的发展与保护之形势也非常严峻,农村集体与城市化的矛盾也日益突出。近年来,我国因农村集体土地拆迁及征收而引起的社会问题不断,农村社会矛盾尤为突出。在城市化的开发和利用过程中,农村集体土地的增值利益也日趋明显,因此,就土地利益的争夺也最为激烈。当下,尤其是农村集体土地带来经济发展而产生的巨大利益如何分配、权利如何行使等一系列由土地引发的社会问题频频发生。十八届三中全会对土地问题也提出了改革,改革的重点就是要建立土地市场。因此,诸多的土地问题必须通过土地权利制度的细分予以解决,通过农村集体土地发展权制度的创新寻找行之有效的解决方案;否则,只能是个案分析的解决方法,这样不仅不利益土地利用的有序进行,更容易造成社会的不公平。
[Abstract]:Land is the most important resource for human survival and the source of all production and existence.Since ancient times, the development and utilization of land, and so on system construction and operation, has always been closely linked with social tranquillity and development, and with the rise and fall of society and the well-being of the people. 2.With the rapid development of urbanization and the establishment of socialist market economy system, the land system of our country is developing deeply.From the early rural contracted management and the paid use of state-owned land to the transfer and transfer of the right to use state-owned land in cities and towns, to the present land expropriation, the circulation of the right to use collective construction land, and so on, all of these show that our country is in the process of land development.The definition of land property rights is becoming more and more clear and deepened.With the deepening development of reform and opening up, people's consciousness of right has been gradually strengthened, and the research on land development right has also been deepened.However, the current land system is difficult to solve the social problems in practice.At the same time, the development and protection of cultivated land resources and rural collective land is also very severe, and the contradiction between rural collective and urbanization is increasingly prominent.In recent years, the social problems caused by the demolition and expropriation of rural collective land in our country are unceasing, especially in rural areas.In the process of development and utilization of urbanization, the value-added benefits of rural collective land are becoming more and more obvious, therefore, the competition for land interests is also the most fierce.At present, a series of social problems caused by land occur frequently, such as how to distribute the huge benefits and how to exercise the rights caused by the economic development brought by the rural collective land.The third Plenary session of the 18th CPC Central Committee also proposed a reform on land issues, the focus of which is to establish a land market.Therefore, many land problems must be solved through the subdivision of land rights system, and through the innovation of rural collective land development right system to find effective solutions; otherwise, it can only be the solution of case analysis.This not only does not benefit the order of land use, it is easy to cause social injustice.
