我国环境公益诉讼中自然人的原告资格问题研究

【摘要】：现阶段,我国环境问题日渐突出,加大环境保护力度已成为重要课题。2013年新《民事诉讼法》确立的环境公益诉讼制度为治理环境问题提供了制度保障,而开展环境公益诉讼,原告范围是要解决的首要问题。在我国近几年的环境立法过程中,社会各界围绕自然人是否具有提起环境公益诉讼的资格展开了多次争论,本文以此为切入点,在深入剖析各方争议焦点,研究环境公益诉讼原告资格基本理论,总结我国部分地方司法实践经验的基础上,结合我国的实际和美日印及台湾地区的立法启示,笔者认为,赋予自然人环境公益诉讼原告资格有其必要性与可行性。
[Abstract]:At the present stage, the environmental problems in our country are becoming more and more prominent, and it has become an important topic to strengthen the environmental protection. The environmental public interest litigation system established by the new Civil procedure Law in 2013 provides a system guarantee for the management of environmental problems, and carries out environmental public welfare litigation.The scope of the plaintiff is the first problem to be solved.In the environmental legislation process of our country in recent years, the social circles have carried out many arguments around whether the natural person has the qualification to file the environmental public interest lawsuit, this article regards this as the breakthrough point, in the thorough analysis each side dispute focal point,On the basis of studying the basic theory of plaintiff qualification in environmental public interest litigation, summing up some local judicial practice experience of our country, combining with the reality of our country and the enlightenment of the legislation of America, Japan and India and Taiwan, the author thinks,It is necessary and feasible to grant plaintiff qualification to natural person environmental public interest litigation.
