互联网域名管理制度对网络言论的规制

【摘要】：通过规制作为网络言论的域名和作为网络言论门户的域名就可以高效地控制网络言论的自由传播。本文通过以下三个方面分析我国域名管理制度如何影响网络言论自由:一是网络域名与网络言论的关系;二是管理全球域名系统的ICANN制定的UDRP在处理域名与商标纠纷时的裁决倾向对网络言论全球保护的影响;三是《中国互联网络域名管理办法》(2004年)对域名注册程序的规制方法,对域名注册管理机构和域名注册服务机构的控制方式。经过理论分析和实证数据的支撑可知,中国顶级域名管理制度通过对域名注册程序的控制,通过对域名注册管理机构和域名注册服务机构提供的域名解析服务的控制,以掌控网络言论在境内和境外间或在境内间的自由传播。因此,掌控了规制域名系统的权力就掌控了对网络言论进行规制的权力。
[Abstract]:By regulating the domain name as the network speech and the domain name as the portal of the network speech, we can control the free spread of the network speech efficiently.This paper analyzes how our country's domain name management system affects the freedom of online speech through the following three aspects: first, the relationship between Internet domain name and online speech;The second is the influence of the ruling tendency of UDRP made by ICANN, which manages the global domain name system, on the global protection of Internet speech when dealing with disputes between domain name and trademark, and the third is the regulation method of domain name registration procedure in China Internet Domain name Administration method (2004).The control of domain name registration administration and domain name registration service.Through theoretical analysis and empirical data, we can see that China's top-level domain name management system controls the domain name registration process, the domain name resolution service provided by the domain name registration administration and the domain name registration service.In order to control the free spread of online speech within and outside China or within the territory.Therefore, the power to control the domain name system controls the power to regulate online speech.
