【摘要】：永久居留制度是指一国政府给予符合一定条件并在本国永久居留的外国人的出入境法规制度,在世界范围内广泛存在,已被人们熟知,美国的绿卡制度就是世界上最早的永久居留制度的雏形。各国的专家学者对永久居留制度有着不同的理解和要求,其主要内容是指一国政府给予符合一定条件的,并在本国长期居住的居留权制度。 2004年8月15日,公安部、外交部联合颁布的《外国人在中国永久居留审批管理办法》开始实施,标志着我国正式建立了外国人永久居留(绿卡)制度。该审批办法对外国人申请在中国永久居留的资格条件,申请所需材料,审批程序,审批权限,《外国人永久居留证》的法律效力等方面做出了具体明确规定。外国人永久居留制度实施10年以来,为我国吸引国外投资和高层次人才来华投资兴业,方便亲属团聚发挥了积极作用,为我国外国人永久居留制度的建立和完善奠定了基础,在一定时间和领域内发挥了重大的作用。改革开放尤其是近几年来,随着我国对内改革和对外开放的步伐进一步加快,我国与国际经济体联系的日益紧密,人员往来的日益频繁和国际人才竞争的加剧,原有的绿卡制度门槛高、适用范围小、审批办法单一等问题较为突出,难以适应当今社会我国日益发展的经济和社会需求,与我国快速发展的经济和社会发展的矛盾进一步加大,在有些行业或领域相当严重。本文通过对当前我国外国人永久居留审批制度现状的分析研究,结合新颁布实施的《中华人民共和国出境入境管理法》和《中华人民共和国外国人入境出境管理条例》等法律法规,以遵循保护国家利益和国民利益为出发点,充分考虑我国经济社会发展的实际水平及社会承受能力等各方面因素,积极借鉴美国、加拿大、新加坡等国出入境移民制度,从推行定额审批和居留担保、社会融入制度入手,力求从制度上解决当前我国外国人永久居留审批过程中出现的问题,维护我国正常的出入境管理秩序,营造良好的涉外治安环境,进一步扩大开放和发展经济。
[Abstract]:The system of permanent residence refers to the system of entry and exit laws and regulations granted by the government of a country to foreigners who meet certain conditions and are permanently resident in their own country. It is widely existing in the world and has been known by people.The green card system in the United States is the earliest permanent residence system in the world.The experts and scholars of various countries have different understandings and requirements for the permanent residence system, the main content of which refers to the right of abode system given by the government of a country which meets certain conditions and has a long-term residence in its own country.On August 15, 2004, the "measures for the examination and approval of foreigners' permanent residence in China", jointly promulgated by the Ministry of Public Security and the Ministry of Foreign Affairs, came into effect, marking the formal establishment of the permanent residence (Green Card) system for foreigners in China.The examination and approval measures specify the eligibility conditions for foreigners to apply for permanent residence in China, the materials required for the application, the examination and approval procedure, the examination and approval authority, the legal effect of the Alien permanent residence permit, and so on.Since the implementation of the permanent residence system for foreigners 10 years ago, it has played an active role in attracting foreign investment and high-level talents to invest in China to start a business, facilitate the reunion of relatives, and laid a foundation for the establishment and improvement of the permanent residence system for foreigners in China.In a certain time and in the field of play a major role.Reform and opening up, especially in recent years, with the pace of China's domestic reform and opening to the outside world further accelerated, our country is increasingly closely linked with international economies, personnel exchanges are increasingly frequent and international competition for talent intensifies.The original green card system has a high threshold, a small scope of application, a single examination and approval method, and so on, so it is difficult to adapt to the growing economic and social needs of our country today.The contradiction with the rapid development of economy and society in our country is becoming more and more serious in some industries or fields.This paper analyzes and studies the current situation of the examination and approval system for the permanent residence of foreigners in China.In combination with the newly promulgated "Law of the people's Republic of China on the Administration of exit and entry" and the "regulations of the people's Republic of China on the Administration of entry and exit of foreigners", the starting point is to follow the protection of national and national interests,Fully considering the actual level of our country's economic and social development and social affordability, and actively learning from the immigration systems of the United States, Canada, Singapore and other countries, starting with the implementation of the quota examination and approval, residence guarantee, and social integration system,This paper tries to solve the problems in the process of examination and approval of permanent residence of foreigners in our country, maintain the normal order of entry and exit administration, create a good security environment concerning foreign affairs, and further expand the opening up and development of the economy.
