农村征迁纠纷解决的法治困境及因应策略——以五个典型征迁纠纷事件为例

【摘要】：农村征地拆迁纠纷解决是我国城市化加速发展时期必然面临的命题。农村征地拆迁关乎各方重大利益,且我国在此方面的法治建构尚不完善,征迁各方"偏离法治的利益博弈"极易产生矛盾乃至于引发流血冲突。农村征地拆迁问题不仅是重大的民生问题,亦是重大的政治问题。城市化进程与空间拓展的必然对应性表明,倘若无法建立行之有效的农村征迁矛盾化解机制,农村征迁矛盾势必成为我国现代化建设过程中的一股重要阻滞力量。因而,深入探究农村征迁纠纷化解机制失效之因由并寻求理性破解之道实乃当务之急。
[Abstract]:The settlement of rural land requisition and demolition dispute is an inevitable proposition in the accelerating development of urbanization in China.The rural land requisition and demolition is related to the important interests of all parties, and the construction of the rule of law in our country is not perfect, so the parties "deviating from the rule of law in the game of interests" are prone to produce contradictions and even cause bloody conflicts.Rural land requisition and relocation is not only a major livelihood issue, but also a major political issue.The inevitable correspondence between urbanization process and spatial expansion indicates that if it is not possible to establish an effective mechanism to resolve the contradiction of rural requisition and relocation, the contradiction of rural requisition and relocation will become an important blocking force in the process of modernization construction of our country.Therefore, it is urgent to probe into the cause of the failure of the dispute resolution mechanism and to find the rational way to solve the dispute.
