论农村股份合作社的财产权结构与法律完善

【摘要】：依照现代企业理念,构建产权明晰、权责明确、政社分开、管理科学的农村股份合作制度是中央深化农村改革的主要措施之一。农村股份合作社在实践中形态各异,呈现出蓬勃发展的趋势,但由于理论研究和立法的明显滞后,其发展过程中尚存在股份合作社财产范围不明确、财产权制度混乱等问题。准确界定农村股份合作社的财产范围,合理架构股份合作社的财产权的结构,是解决农村股份合作社财产权制度困惑,保障合作社成员财产权利的逻辑起点和基础。
[Abstract]:According to the concept of modern enterprises, it is one of the main measures for the central government to deepen the rural reform by constructing the clear property rights, clear power and responsibility, separating the government from the society, and managing the scientific system of rural share cooperation.Rural stock cooperatives have different forms in practice, showing a trend of vigorous development, but due to the obvious lag of theoretical research and legislation, there are still some problems in its development process, such as unclear property scope of stock cooperatives, confusion of property rights system, and so on.It is the logical starting point and foundation to solve the confusion of the property right system of the rural stock cooperatives and to guarantee the property rights of the members of the cooperative by defining the property scope of the rural stock cooperatives and rationally structuring the structure of the property rights of the stock cooperatives.
