终身教育立法研究之与现有法律体系的冲突与协调

【摘要】：源于终身教育对公民和国家可持续发展的强大作用,法制化的推进手段成为重要选择,终身教育立法在我国已被提上议事日程。国家终身教育立法如果制定,我国教育法律体系又将增加一部国家教育立法。各项法律法规纵横交错,终身教育法不可避免地会与现有的法律体系产生冲突,法律协调是个值得关注的问题。宪法和教育法是国家终身教育立法的上位法,其关于终身教育发展的原则和精神在终身教育立法中必须予以遵守和贯彻。其它教育类法律是终身教育法的同位法,在各自范围内实行,奉行"特别法优于一般法"的冲突处理原则。地方终身教育条例是国家终身教育立法的下位法,不得与国家立法相抵触。其他相关立法也需进行调整与完善,以保证法律体系的协调与统一。
[Abstract]:Due to the strong role of the lifelong education of citizens and the state of sustainable development, legalization means has become an important choice, lifelong education legislation in our country has been put on the schedule. If the development of lifelong education legislation, the legal system of education in China will be added to a national educational legislation. The laws and regulations of lifelong education law arranged in a crisscross pattern. Will inevitably conflict with the existing legal system, legal coordination is a matter of concern. The Constitution and the education law is the law of lifelong education legislation of the country, the development of lifelong education principle and spirit must be complied in lifelong education legislation. Other types of legal education is the lifelong education law of parity law in practice, the principles of conflict management within their respective areas, adhere to the "special law is superior to the common law". The local regulations of lifelong education lifelong education legislation is the lower state Law should not be incompatible with national legislation. Other relevant legislation should be adjusted and perfected to ensure the coordination and unification of the legal system.
