新闻记者权利的保护与行为的规制

【摘要】：当今社会是信息化的社会,各种传播信息的新媒体迅猛发展,通过新闻媒体获取信息、了解社会百态,已成为我们的日常生活所需。面对庞杂的各种信息,客观真实是我们广大信息接收者最基本的要求,也是新闻记者最基本的职业标准。新闻记者作为信息传播的源头,对于保障信息真实性和公民知情权的实现,具有重大的使命。在我国当前的社会环境下,新闻记者在承担着重大责任的同时也面临着巨大的挑战,新闻记者被打被抓事件不断映入眼帘,无时无刻不在牵动着奋斗在一线的新闻记者紧张的神经。目前我国相关法律没有明文规定新闻记者的各项权利义务是新闻记者权利受侵事件频发以及事后得不到及时救济的一个重要因素。与此同时,新闻记者在新闻采访报道中也存在着一些不当行为,有偿新闻、假新闻现象不断考验新闻记者的道德底线,为了获取新闻素材,侵害他人合法权益的情形也时常发生,违背了新闻记者应当遵守的职业规范,辱没了“无冕之王”的称号。面对新闻记者权利被侵以及新闻记者侵权现象不断发生的现实环境,我们有必要理清新闻记者享有的权利和应承担的义务,对新闻记者的权利进行立法保护,对其侵权行为进行规制。本文拟分四个章节来论述新闻记者在新闻采访报道中权利的保护和行为的规制问题。首先阐述新闻记者采访报道权利及义务的法理基础和相关规定,结合具体的新闻记者权利被侵以及侵权现象,分析这些现象产生的原因,探究新闻记者享有的合法权益和应承担的法定义务,寻求一种新闻记者权利与义务的平衡状态,从而为新闻记者权利的保护和行为的规制提供有价值的参考依据,促进我国的新闻事业在法治的轨道上有效运行。
[Abstract]:Nowadays, the society is an information society, and all kinds of new media to spread information are developing rapidly. It is necessary for us to get information through news media and get to know all kinds of society.In the face of various kinds of information, objective reality is the most basic requirement of our vast number of information recipients, and also the most basic professional standard of journalists.As the source of information dissemination, journalists have a great mission to guarantee the authenticity of information and the realization of citizens' right to know.In the current social environment of our country, journalists are facing enormous challenges while shouldering major responsibilities. The incidents of journalists being beaten and arrested have constantly come into view.The nervous nerves of journalists struggling on the front line are always at stake.At present, the rights and obligations of journalists are not explicitly stipulated in the relevant laws of our country.At the same time, journalists also have some improper behavior in their news coverage. Paid news and false news continue to test journalists' moral bottom line. In order to obtain news material,Violations of the legitimate rights and interests of others also occur frequently, violating the professional norms that journalists should abide by and disgracing the title of "uncrowned king".In the face of the fact that the rights of journalists have been violated and the infringing phenomenon of journalists is constantly occurring, it is necessary for us to clarify the rights and obligations of journalists and to legislate to protect the rights of journalists.The tort is regulated.This paper is divided into four chapters to discuss the protection of rights and the regulation of behavior.First of all, it expounds the legal basis and relevant provisions of journalists' right and obligation to interview and reports, and analyzes the causes of these phenomena in combination with the specific infringement of journalists' rights and infringing phenomena.This paper explores the legal rights and interests of journalists and the legal obligations they should undertake, and seeks a balance between the rights and obligations of journalists, thus providing a valuable reference basis for the protection of journalists' rights and the regulation of their behavior.To promote the effective operation of China's journalism on the track of the rule of law.
