公共租赁住房准入机制法律问题研究

【摘要】:居住是最基本的民生需求之一,保障公民住宅权的实现是政府义不容辞的责任。公共租赁住房作为我国正在逐步发展的保障性住房形式,主要是解决我国中低收入住房困难居民的住房问题,通过与廉租住房、经济适用住房的“无缝对接”共同构成我国保障住房体系。发展公共租赁住房制度,是一项多目标的社会福利措施,不仅可以使收入较低的家庭安居乐业,提高其生活水平,进而确保社会的安定;并且可以抑制房价,有效改善居住环境及提高土地利用价值。所以,一个恰当的公共租赁住房政策,其所获得的成果,具有经济、社会、环境等多层面的功能。本文站在法律的角度,从以下四个方面论述了公共租赁住房在准入机制方面的一些问题。 第一部分:公共租赁住房准入的法学基本理论。该部分从分析公共租赁住房准入机制的概念入手,进而论述了公共租赁住房准入机制的法理基础,,最后阐释公共租赁住房准入机制的社会功效。 第二部分:国外公共租赁住房准入机制的法律规定及评价。通过介绍美国、韩国、新加坡的公共租赁住房准入机制的规定,总结域外住房制度中值得我国公共租赁住房准入机制借鉴的经验。 第三部分:我国公共租赁住房准入机制的立法现状及缺陷分析。介绍中央人民政府关于公共租赁住房准入机制了哪些规定,而各级人民政府又出台了哪些管理办法。通过以上分析,总结我国公共租赁住房准入机制存在的缺陷。 第四部分:完善公共租赁住房准入机制的法律建议。此部分是本文的重点,在前文分析的基础之上,分别从制定全国统一立法、扩大准入对象覆盖范围、制定严格的准入审核程序、加强准入的监管、完善准入的法律责任五个方面加以完善。
[Abstract]:Residence is one of the most basic needs of people's livelihood, and it is the government's duty to ensure the realization of citizens' right to housing.Public rental housing, as a form of affordable housing that is gradually developing in our country, mainly solves the housing problem of the residents with low and middle income housing difficulties, through the use of low-rent housing.The "seamless docking" of affordable housing constitutes our country's housing security system.The development of a public rental housing system is a multi-objective social welfare measure that not only enables low-income families to live and work in peace and contentment, improves their living standards, and thus ensures social stability, but also inhibits housing prices.Improve living environment and land use value effectively.Therefore, an appropriate public rental housing policy, its results, with economic, social, environmental and other aspects of the function.From the point of view of law, this paper discusses some problems in the access mechanism of public rental housing from the following four aspects.The first part: the basic legal theory of public rental housing access.This part begins with the analysis of the concept of the admission mechanism of public rental housing, and then discusses the legal basis of the admission mechanism of public rental housing, and finally explains the social efficacy of the admission mechanism of public rental housing.The second part: the legal regulation and evaluation of the admission mechanism of public rental housing abroad.By introducing the regulations of the admission mechanism of public rental housing in the United States, South Korea and Singapore, this paper sums up the experience of foreign housing system which is worthy of our country's public rental housing access mechanism.The third part: the legislation present situation and the flaw analysis of our country public rental housing admittance mechanism.Introduce the Central people's Government on the admission mechanism of public rental housing regulations, and people's governments at all levels issued what management measures.Through the above analysis, summarizes our country public rental housing admittance mechanism existence flaw.The fourth part: the legal suggestion of perfecting the admittance mechanism of public rental housing.This part is the focus of this paper, on the basis of the previous analysis, from the formulation of national uniform legislation, the expansion of the coverage of access objects, the establishment of strict access audit procedures to strengthen the supervision of access,Perfect access to five aspects of legal responsibility to perfect.
