行政执法方式的创新及其保障

【摘要】：依法治国的理念要求依法行政,依法行政是建设社会主义法治政府的核心,对行政执法方式进行创新,是社会发展变化的必然趋势。现今行政执法实践中各种暴力冲突时有发生,这种情况造成了社会的不稳定,极大地增加了行政成本,使得整个社会的治理成本激增,不仅与我国“以人为本”的理念不符,且不利于和谐社会的顺利实现。在有关行政执法的过程中,如何让执法主体适应社会的新变化,创新行政执法方式,让行政执法方式能够得到保障,是一个紧迫且现实的问题。不同类型的执法方式,实现的法律目的不同。对执法方式进行创新,使得公民对执法机构的执法工作能够给予理解和配合,有利于提高执法工作的效率和效能。本文在对行政执法方式初步了解后,阐述了我国行政执法方式的存在的种种问题,如不文明执法现象的屡见不鲜、执法活动的“运动化”及执法趋利现象的严重性；并对于这些问题进行了相关成因分析,包括了执法人员的素质问题、我国法制不健全以及监督机制不合理。最后,针对行政执法方式存在的问题及原因的分析,从三个方面提出了创新行政执法方式的路径设计与保障,从努力实现行政执法方式的民主化与和解制度的引入上去完善行政执法方式的民主机制；从反思行政执法方式的理念、行政体制的改革与法律制度的保障上推行行政执法方式的常效机制；从行政执法方式的监督、自由裁量权的规范以及公示制度的建立上去健全行政执法方式的公正机制。创新之路任重而道远,如何排除在创新之路中遇到的阻力,希望本文的内容能够对我国的行政执法方式实践有所启示。
[Abstract]:The idea of governing the country by law requires administration by law, which is the core of building a socialist government ruled by law. It is an inevitable trend of social development and change to innovate the way of administrative law enforcement. Nowadays, various kinds of violent conflicts occur frequently in the practice of administrative law enforcement, which has caused social instability, greatly increased the administrative cost, and made the whole society's governance cost surge, which is not only inconsistent with the concept of "people-oriented" in our country. And is not conducive to the smooth realization of a harmonious society. In the process of administrative law enforcement, it is an urgent and realistic problem how to make the subject of law enforcement adapt to the new changes of society, innovate the way of administrative law enforcement, and let the way of administrative law enforcement be guaranteed. Different types of law enforcement methods achieve different legal purposes. The innovation of law enforcement means enables citizens to understand and cooperate with law enforcement agencies, which is conducive to improving the efficiency and effectiveness of law enforcement. After the preliminary understanding of the administrative law enforcement, this paper expounds the problems existing in the administrative law enforcement in our country, such as the common occurrence of the uncivilized law enforcement, the "movement" of the law enforcement activities and the seriousness of the phenomenon of law enforcement. The causes of these problems are analyzed, including the quality of law enforcement personnel, the imperfect legal system and the unreasonable supervision mechanism. Finally, according to the analysis of the existing problems and reasons of the administrative law enforcement, this paper puts forward the path design and guarantee of the innovation of the administrative law enforcement from three aspects. From the efforts to realize the democratization of administrative law enforcement and the introduction of reconciliation system to improve the democratic mechanism of administrative law enforcement, from the reflection of the concept of administrative law enforcement, The reform of the administrative system and the guarantee of the legal system carry out the regular mechanism of the administrative law enforcement, and perfect the fair mechanism of the administrative law enforcement from the supervision of the administrative law enforcement, the standardization of the discretion and the establishment of the publicity system. The road of innovation is heavy and the road is long, how to eliminate the resistance in the road of innovation, I hope the content of this paper can enlighten the practice of administrative law enforcement in our country.
