论构建我国公职人员财产申报制度的障碍及对策

【摘要】：公职人员财产申报制度是公认的能够有效遏制、打击腐败的法律制度。中国的公职人员财产申报制度由于受到多方因素的阻碍，迟迟无法建立。本文概括了公职人员财产申报制度的概念、价值与发展脉络，论证财产申报制度的必要性，，从申报主体、申报内容、核查、公示机制、法律责任等方面分析了我国公职人员财产申报制度构建工作遇到的具体障碍，并结合我国国情与域外经验提出了对策建议。
[Abstract]:The property declaration system of public officials is recognized as a legal system which can effectively curb and combat corruption. The property declaration system of public officials in China has been hindered by many factors. This paper summarizes the concept, value and development of the property declaration system for public officials, and demonstrates the necessity of the property declaration system, including the declaration subject, the declaration content, the verification, and the publicity mechanism. This paper analyzes the obstacles encountered in the construction of the property declaration system of public officials in China from the aspects of legal liability, and puts forward some countermeasures and suggestions based on the national conditions and overseas experience of our country.
