论我国公共租赁住房法律制度的完善

【摘要】:“人人都有适当住房”是我国改善民生所面临的重要课题。但是,当前火爆的房地产市场导致商品房价格畸高,日益高昂的住房价格导致城市中的中低收入群体住房困难问题日益显现,如果这个问题得不到有效解决将导致严重的社会问题。我国政府对于这个问题日益重视,先后出台了“廉租房”、“经济适用房”和“限价商品房”等政策来解决我国中低收入群体的住房困难的现状。取得了很好的社会效果,解决了很多人的住房难问题。但是,还存在着一些既不符合以上条件而又很难通过市场解决住房问题的“夹心层”群体。他们被排除在这些住房保障政策之外,“夹心层”群体住房的问题依然没有得到解决,而公共租赁住房的制度的出现则为这一难题的解决提供了一个有效的途径。 公共租赁住房制度在解决“夹心层”群体的住房困难的方面发挥着无可替代的作用。虽然公共租赁住房制度刚刚开始发展,但是在我国各地发展迅速,大量的公共租赁住房出现,使大量的“夹心层”群体拥有了自己的住房。公租房制度的出现有效的干预了我国房地产市场,促进了住房保障制度的完善,实现了公共住房资源的和谐、可持续发展,完善了我国租赁住房市场体系。 我国公共租赁住房制度已经有了一定的发展,但是,它发展的时间还比较短,还有很多不足的地方。不论是在立法实践方面,还是在关于公共租赁住房法律制度的理论方面的研究都比较少,还没有有影响的研究出现。我国公共租赁住房制度在经济学和管理学方面的研究比较多,在法律方面的研究现在还是空白的状态。我国公共租赁住房法律制度并不完善,现在仅靠部门规章和政策性文件来管理公共租赁住房。然而,这些法律文件普遍存在着立法层次较低,缺乏全国统一的立法等等的问题。而在具体的规定中,也存在着公共租赁住房的入住对象和入住条件不明确、不合理,公共租赁住房管理机制的缺失以及公共租赁住房租赁期限和退出机制的不合理等等的缺陷。 所以,本文旨在通过研究域外现有的较为完善的公共租赁住房法律制度,比较分析我国公共租赁住房法律制度存在的弊端,并借鉴域外先进经验,结合我国当前的现状,提出相应的建议。本文将综合运用文献分析法、比较分析法以及归纳分析法等等的方法,以期对我国公共租赁住房法律制度做较为深入的研究,完善我国的公共租赁住房法律制度,使之成为一个多层次、全面保障的住房保障法律制度,推动社会的和谐和进步。 本文正文主体部分的结构分为四大部分。第一部分是“公共租赁住房法律制度概述”,该部分主要阐明了公共租赁住房法律制度的概念及我国公共租赁住房的概念和特征,探讨了公共租赁住房法律制度的现实意义,并从法的渊源的角度阐述了我国公共租赁住房法律制度的立法现状。第二部分是“域外公共租赁住房立法和实践及其借鉴”,这一部分通过对英国、美国、德国、新加坡以及我国香港地区公共租赁住房法律制度的立法和实践的分析,阐释了其他国家和地区公共租赁住房立法和实践对我国的公共租赁住房发展的可供借鉴之处。第三部分则是“我国公共租赁住房法律制度存在的问题”,这一部分通过分析我国公共租赁住房的法律规定和地方规章政策等,结合我国当前各地公租房制度的状况,说明了我国公共租赁住房法律制度立法与实践中存在的主要问题。最后一部分是“完善我国公共租赁住房法律制度的建议”,该部分借鉴域外的先进经验,针对当前我国公共租赁住房法律制度所出现的各种问题,提出了完善的基本原则和相应的具体建议。
[Abstract]:"Everyone has proper housing" is an important issue for the improvement of the people's livelihood. However, the current hot real estate market leads to a high price of commodity housing, and the increasing housing price has caused the problem of housing difficulties in the middle and low income groups in the city. If this problem is not effectively solved, it will lead to a serious society. Problem. Our government attaches great importance to this problem. It has introduced the policy of "low rent housing", "affordable housing" and "limited price commodity house" to solve the housing difficulties of middle and low income groups in China. It has achieved good social effects and solved many people's housing difficulties. However, there are still some non conforms. In addition to the above conditions, it is difficult to solve the "sandwich" group of housing problems through the market. They are excluded from these housing security policies. The problem of "sandwich" housing is still not solved, and the emergence of public rental housing system provides an effective way to solve this problem.
The public rental housing system has played an irreplaceable role in solving the housing difficulties of the "sandwich" group. Although the public rental housing system has just begun to develop, it has developed rapidly in all parts of China, and a large number of public rental housing appears, making a large number of "sandwich" groups have their own housing. The system of public rental housing in our country has been developed, but the time of its development is relatively short, and there are still a lot of inadequacies. No matter in legislative practice or in the theory of the legal system of public rental housing, there are few studies that have influence. There are many studies in economics and management, and the legal research is still blank. The legal system of public rental housing in China is not perfect. Now, the public rental housing is managed only by department rules and policy documents. However, these legal documents are generally low in legislative level and lack of national unity. One of the legislation and so on, and in the specific provisions, there is also a public rental housing object and occupancy conditions are not clear, unreasonable, the lack of public rental housing management mechanism and the lack of public rental housing lease term and exit mechanism is not reasonable and so on.
Therefore, the purpose of this paper is to compare the existing legal system of public rental housing outside the region, compare and analyze the drawbacks of the legal system of public rental housing in our country, and draw on the advanced experience of foreign countries, combine with the current situation of our country, and put forward the corresponding suggestions. This article will use the literature analysis method, comparative analysis method and induction. In order to make a more thorough research on the legal system of public rental housing in China and improve the legal system of public rental housing in our country, the law system of public rental housing in China will be perfected to make it a multi-level, comprehensive protection legal system for housing security and promote the harmony and progress of the society.
The structure of the main body part of the text is divided into four parts. The first part is the "summary of the legal system of public rental housing". This part mainly clarifies the concept of the legal system of public rental housing and the concept and characteristics of the public rental housing in our country, and probes into the practical significance of the law system of public rental housing, and from the angle of the origin of the law. The legislative status of the legal system of public rental housing in China is expounded. The second part is "the legislation and practice of extraterritorial public rental housing and its reference". This part explains the legislation and practice of the legal system of public rental housing in the UK, the United States, Germany, Singapore and the Hongkong region of China. The legislation and practice of public rental housing in the district can be used for reference in the development of public rental housing in China. The third part is "the problem of the legal system of public rental housing in China". This part analyzes the public rental housing system in China by analyzing the legal provisions and local rules and policies of public rental housing in China, and combining the public rental housing system in our country at present. The main problems in the legislation and practice of the legal system of public rental housing in China are explained. The last part is the suggestion of "perfecting the legal system of the public rental housing in our country". This part draws on the advanced experience abroad, and puts forward the perfection of the problems arising from the legal system of public rental housing in our country.
