宗教法概念新探——学术传统与时空变迁

【摘要】：宗教法是宗教法学的基本概念,决定着宗教立法的基本内容,关系着宗教法学的研究取向。作为沟通国家立法与宗教规范的中间概念,是调整宗教社会关系、维护国家政治稳定及社会和谐的基石之一。长期以来,我国学术界主要借鉴西方国家的理论体系和研究成果,忽略了中国文化多元语境下宗教法内涵的理论探讨和归纳,相关研究呈现出碎片化、自说自话以及罔顾时空语境变迁的特点。相对而言,西方学术界对宗教法的界定和使用颇具创造性。造成这样的结果既有学术传统的原因,又与中西学界对时空变迁的整体把握和关注力度有关。因此,重新检视宗教法的基本内涵具有重要的理论价值和现实意义。宗教法概念的界定应当立足于中国一体化之下多元族群、宗教、教派的具体时空语境,应当具有自身的开放性和包容度,在中国语境下,宗教法是指保护公民宗教信仰自由权利,调整宗教社会关系的有关国家法律规范与制度的统称。
[Abstract]:Religious law is the basic concept of religious law, which determines the basic content of religious legislation and the research orientation of religious jurisprudence. As an intermediate concept to communicate national legislation and religious norms, it is one of the cornerstones of adjusting religious social relations and maintaining national political stability and social harmony. For a long time, the academic circles in our country have learned from the West. The theoretical system and research results of the state ignore the theoretical discussion and induction of the connotations of the religious law under Chinese cultural pluralism, and the related research presents a fragmented, self speaking and disregard of the changes in the context of time and space. In contrast, the western academic circles are quite creative in the definition and use of the religious law. The reason for the academic tradition is related to the overall grasp and attention of the Chinese and Western academics on the change of space and time. Therefore, it is of great theoretical and practical significance to re examine the basic connotation of religious law. In the context of China, religious law refers to the general name of the relevant national legal norms and systems for the protection of citizens' right to freedom of religious belief and the adjustment of religious social relations in Chinese context.
