留守儿童受教育权问题及其对策研究

【摘要】:留守儿童是我国当前快速城市化的特定历史发展时期的独特产物,是随着我国社会经济的发展,在我国经济的转型期而产生的重大社会问题,引起了国家、社会、家庭、学校和社区等各个群体的共同关注。其中留守儿童受教育权问题,也逐渐成为我国理论研究的热点问题。关注留守儿童受教育权问题,不仅关乎着留守儿童的未来,史关乎我国的发展大计。 本文将分成四个部分对留守儿童受教育权问题及其对策进行阐述: 第一部分,概述了留守儿童受教育权的基本理论。阐述了留守儿童的含义,在前人研究的基础上尝试对留守儿童概念进行完整地概括。对留守儿童产生的背景进行深入剖析,了解当前我国留守儿童的生存现状。同时对受教育权的内容加以归纳概括,从受教育权的概念、性质进行分析,使我们了解受教育权的重要性。最后将留守儿童与受教育权理论相结合,详细阐述了留守儿童受教育含义,及保护留守儿童受教育权的价值所在 第二部分,对当前我国留守儿童受教育权的现状进行分析。从家庭教育、学校教育、社会教育三个方面详细阐述了当前我国留守儿童受教育权的具体现状。从这些现状当中,了解当前我国留守儿童受教育权问题严重到什么程度。 第三部分,主要分析我国留守儿童受教育权存在问题的原因。从我国经济,教育法律体系,政府管理制度及其执法,受教育权的救济途径和受教育权主体自身等方面剖析,找出在各环节留守儿童受教育权存在问题的具体原因,以便我们在提出对策时对症下药。 第四部分,主要分析如何完善当前我国教育法律体系,为留守儿童受教育权提供良好的法律保障。制定专门针对留守儿童的教育法规,完善法各种律救济途径。同时强调缩小城乡差距,从经济层面解决我国留守儿童受教育权面临的某些问题。在政府的管理制度上,改革户籍管理制度及教育财政管理制度,努力实现城乡平等。在公民自身方面,加强法制教育宣传,提高自我的维权意识。唯有如此,才能更好地保障留守儿童的受教育权。
[Abstract]:The left-behind children are the unique products of the specific historical development period of our country's rapid urbanization. They are the major social problems arising from the development of our country's social economy and the transition period of our country's economy, which have caused the country, the society, the family, the country, the society, the family, the country, the society and the family. This paper expounds the meaning of left-behind children and attempts to generalize the concept of left-behind children on the basis of previous studies. The background of left-behind children is deeply analyzed to understand the current survival situation of left-behind children in China. At the same time, the content of the right to education is summarized and analyzed from the concept and nature of the right to education, which makes us understand the importance of the right to education. Finally, by combining the theory of left-behind children with the right to education, the meaning of education for left-behind children and the value of protecting left-behind children's right to education are expounded in detail. The second part analyzes the current situation of education right of left-behind children in our country. This paper expounds in detail the present situation of the right to education of left-behind children in China from three aspects: family education, school education and social education. From these present situation, know our country left-behind children's right to education problem to what extent. The third part mainly analyzes the causes of the problems in the right to education of left-behind children in China. From the aspects of economy, education law system, government management system and its law enforcement, the relief ways of the right to education and the main body of the right to education, the author finds out the specific reasons for the problems existing in the right to education of children left behind in every link. So that when we propose countermeasures, the right remedy. The fourth part mainly analyzes how to perfect the current education legal system of our country to provide good legal guarantee for left-behind children's right to receive education. To formulate educational laws and regulations for left-behind children and improve the legal remedies. At the same time, it emphasizes reducing the gap between urban and rural areas and solving some problems about the right to education of left-behind children in China from the economic level. In the government management system, reform the household registration management system and educational financial management system, and strive to achieve urban and rural equality. In the aspect of citizens themselves, we should strengthen the publicity of legal education and improve our consciousness of protecting rights. Only in this way, can the right to education of left-behind children be better protected.
