【摘要】：地方政府的法治指标评估体系构建,是法治政府建设的具体要求。法治政府作为新兴的一种政府治理模式,在世界各国范围内得以普遍认同。由于法治政府是一种价值评判标准,本身具有很强的主观性,各级政府很难把握尺度和程度,法治政府建设在实际工作中过于盲目,更多的时候得不到行政领导的重视,口号化、实用化、利益化倾向严重,法治政府建设陷入困境,缺少科学的监督和评价机制。这就需要一种可以量化的标准来衡量其实现程度,监督其完成进度。法治指标评估体系构建研究就是着眼于一个社会的法治程度而产生的,其源起于西方国家的研究。本文通过阐释地方政府法治指标评估体系的内涵,包括其构建的理论意义和实践意义,深入剖析了该评价体系构建的可行性分析,比照和总结了国内外的量化法治实践的典型案例经验,提出该评价体系构建的较为全面的设想,完善了现有的地方政府法治指标评估体系。本文除了绪论以外,共分为五个部分：第一部分从地方政府法治指标评估体系内涵的剖析入手,探究该评估体系构建的理论基础和实践基础。第二部分介绍了法治指标评估体系国内外实践的典型案例,包括“世界正义工程”提出的地方政府法治指标评估体系和我国香港、余杭地区等地方政府法治指标评估体系实践。第三部分深入分析地方政府法治指标评估体系的设定,所需注意的设定原则、设定问题及设定的具体内容。第四部分继续深入探析地方政府法治指标评估体系的实施。第五部分对本文进行了总结,说明地方政府法治指标评估体系构建对于推进我国法治建设的重要性,推动法治政府的建设。
[Abstract]:The construction of local government's index evaluation system of rule of law is the concrete requirement of the construction of rule of law government. As a new mode of government governance, the rule of law government is universally accepted in the world. Because the rule of law government is a kind of value judgment standard, has the very strong subjectivity itself, the government at all levels is very difficult to grasp the scale and the degree, the rule of law government construction is too blind in the actual work, more often does not receive the executive leader's attention. Slogan, practicality, benefit tendency are serious, the construction of government by law is in difficulty, lack of scientific supervision and evaluation mechanism. This requires a quantifiable standard to measure the extent of its implementation and monitor its progress. The study on the construction of index evaluation system of rule of law is based on the degree of rule of law in a society. By explaining the connotation of the evaluation system of local government's rule of law, including the theoretical and practical significance of its construction, this paper analyzes the feasibility of the construction of the evaluation system. This paper compares and summarizes the typical case experience of quantitative rule of law practice at home and abroad, puts forward a more comprehensive assumption of the construction of the evaluation system, and perfects the existing evaluation system of the rule of law index of local government. In addition to the introduction, this paper is divided into five parts: the first part from the analysis of the connotation of the evaluation system of local government rule of law, explore the theoretical and practical basis of the evaluation system. The second part introduces the typical cases of the evaluation system of the rule of law index at home and abroad, including the evaluation system of local government's rule of law proposed by the "World Justice Project" and the practice of the evaluation system of the local government's rule of law index, such as Hong Kong and Yuhang area of our country. The third part deeply analyzes the setting of the evaluation system of local government's rule of law, the setting principle, the setting problem and the concrete content of the setting. The fourth part continues to explore the implementation of the local government index evaluation system of the rule of law. The fifth part summarizes this article, and explains the importance of the evaluation system of the local government's rule of law for promoting the construction of our country's rule of law and promoting the construction of the rule of law government.
