论传染病防治领域医师对第三人的披露义务

【摘要】：传染病防治领域不认同医师对患者有绝对的保密义务。根据《传染病防治法》,医师对第三人承担了一定的注意义务,但医师是否因此而对第三人承担披露义务,需要做区分探讨。医师对第三人承担披露义务能更有效地防范法定传染病的传播风险,保护第三人的生命健康。但不宜让医师承担过于宽泛的披露义务,需要对披露义务的对象、内容和方式做出限制。披露义务当是在具备必需性、紧迫性时做出,是对保密义务的必要限制,因而应在《传染病防治法》《艾滋病防治条例》等法律法规中对披露义务做出明确的规定。
[Abstract]:The field of infectious disease prevention and treatment does not agree that physicians have an absolute duty of confidentiality to patients. According to the Prevention and treatment of Infectious Diseases Law, doctors have a certain duty of care to the third person, but it is necessary to distinguish whether the physician should bear the obligation of disclosure to the third person. The disclosure obligation of physician to the third person can prevent the spread risk of the legal infectious disease more effectively and protect the life and health of the third person. However, it is not suitable for doctors to assume the obligation of disclosure too broadly, and the object, content and manner of disclosure obligation should be restricted. The obligation of disclosure should be made when it is necessary and urgent and a necessary limitation to the obligation of confidentiality, so it should be clearly stipulated in the laws and regulations such as the Law on Prevention and Control of Infectious Diseases and the regulations on the Prevention and Control of AIDS.
