长春市林业行政执法中的权、责清单落实研究

【摘要】:地方政府的工作部门建立并执行权力清单、责任清单模式的“两单”制度,是党中央、国务院在新时期、新形势、新常态下要求的重要改革使命。党的十八届三中全会提出:“推行地方各级政府及其工作部门权力清单制度,依法公开权力运行流程”。四中全会提出:“依法全面履行政府职能,推进机构、职能、权限、程序、责任法定化,推行政府权力清单制度”。党中央、国务院在推动新一轮地方政府和工作部门职能转变、简政放权和机构编制改革时,明确要求“梳理各级政府部门的行政职权,公布权、责清单,规范行政裁量权,明确责任主体和权力运行流程”。当前,以权力清单、责任清单的布置、建立、实施和监督为流程,各级地方政府和工作部门以全面依法行政为目的履行政府相关职能,促进政府改革、转变、权责明确、流程优化等内容为核心,以简政放权和规范行政部门拥有的权力为重点,进一步理清并明确政府之间和部门之间的权力边界,进一步将权力运行规范化,强化权力与责任主体的监督,加强行政管理方式创新,阳光下行使权力,努力打造“权界清晰、分工合理、权责一致、运转高效、法制保障”的行政职能改革目标,让行政管理部门身的治理体系和职能与时俱进,推进全面深化改革的前进步伐。长春市林业局按照市委、市政府的要求,结合本市林业行政管理部门行政执法过程中的现实情况,对林业行政管理部门相关的行政执法权力清单、责任清单项目内容进行了全面梳理,对“两单”建立和实施方案深入开展落实,对长春市各级涉林行业部门的清单建立工作有者鲜明的导向作用。本文将选择长春市林业行政执法中的权、责清单落实作为研究对象,通过查阅有关文件资料,文献研究等方法,对长春市林业行政执法权力清单、责任清单建立与实施的相关背景与由来,理清林业行政职权、职责中权、责清单落实步骤。阐述林业行政执法权、责清单落实的方案、梳理和清理情况、采用“三报三回”的审核形式、公布方式与建立相关监督管理机制等相关现状。展示林业行政执法权、责清单落实的依法确定过程、实行“身份证”式管理、优化运行流程、开展公众评议、加强监督机制和实行动态管理等具体成效。分析林业行政执法权、责清单相关法律依据不完善、管理层级和配置不清晰、工作易“形式化”和执法能力不足等相关存在的问题。在“两张清单”制度框架下,提出对进一步改进和优化林业行政执法工作的法制化水平、科学化水平、监督实效和复合管理体系等内容提出对策建议。
[Abstract]:It is an important reform mission for the Party Central Committee, the State Council in the new period and the new normal to establish and implement the "two single" system of the mode of power list and responsibility list in the work departments of the local government. The third Plenary session of the 18th CPC Central Committee put forward: "to carry out the system of list of powers of local governments at all levels and their working departments, and to open the operation process of power according to law." The fourth Plenary session of the CPC Central Committee proposed: "to comprehensively perform government functions in accordance with the law, to promote the legalization of institutions, functions, powers, procedures, and responsibilities, and to carry out the system of government power lists." The Party Central Committee and the State Council, in promoting a new round of functional changes in local governments and work departments, streamlining the power of administration and reform of the organizational establishment, have clearly requested "to sort out the administrative functions and powers of government departments at all levels, to promulgate lists of powers and responsibilities, and to standardize administrative discretion," Clear responsibility of the main body and the operation of power flow. At present, with the arrangement, establishment, implementation and supervision of the list of powers and responsibilities as the process, local governments and work departments at all levels perform the relevant functions of the government in order to comprehensively administer according to law, promote government reform, change, and have clear powers and responsibilities, Process optimization and other content as the core, focusing on the decentralization of government and the regulation of the power of administrative departments as the focus, further clarify and clear the power boundary between governments and departments, and further standardize the operation of power. Strengthen the supervision of the power and responsibility subject, strengthen the innovation of the administrative management mode, exercise the power under the sun, and strive to create the reform goal of the administrative function of "the right field is clear, the division of labor is reasonable, the power and responsibility are consistent, the operation is efficient and the legal system is guaranteed". Let the management system and function of the administrative department keep pace with the times and advance the pace of deepening the reform in an all-round way. The Changchun Forestry Bureau, in accordance with the requirements of the municipal party committee and the municipal government, and in the light of the actual situation in the administrative law enforcement process of the forestry administration department of this city, lists the relevant administrative law enforcement powers of the forestry administration department. The contents of the responsibility list project are comprehensively combed out, and the establishment and implementation of the "two single" projects are carried out in depth, which has a distinct guiding effect on the establishment of the list of departments involved in forest industry at all levels in Changchun. This article will select Changchun forestry administration law enforcement right, the responsibility list implementation as the research object, through consulting the related document material, the literature research and so on method, to Changchun forestry administration law enforcement power list, The related background and origin of the establishment and implementation of the responsibility list are clarified, and the implementation steps of the administrative authority, the right in the duty and the list of responsibilities are clarified. This paper expounds the implementation scheme of forestry administrative law enforcement right and responsibility list, combs and cleans up the situation, adopts the auditing form of "three reports and three returns", promulgates the way and establishes the relevant supervision and management mechanism and so on. It shows the process of determining forestry administrative law enforcement right and responsibility list according to law, implements "ID card" management, optimizes operation flow, carries out public comment, strengthens supervision mechanism and implements dynamic management, and so on. This paper analyzes the problems related to forestry administrative law enforcement power, imperfect legal basis of responsibility list, unclear management level and disposition, easy "formalization" of work and insufficient law enforcement capacity. Under the framework of "two lists" system, this paper puts forward some countermeasures and suggestions for further improving and optimizing the legalization level, scientific level, supervision effect and compound management system of forestry administrative law enforcement.
