完善立法监督制度——兼论宪法委员会的创设

【摘要】：正党的十八届三中全会提出,要进一步健全宪法实施监督机制和程序,把实施宪法要求提高到一个新水平。十八届四中全会进一步提出,完善全国人大及其常委会宪法监督制度,健全宪法解释程序机制;加强备案审查制度和能力建设,依法撤销和纠正违宪违法的规范性文件,等等。为什么党中央要提出完善全国人大及其常委会宪法监督制度?(一)立法监督是法治建设的基石,在法治监督体系之中处于核心地位
[Abstract]:The third Plenary session of the 18th CPC Central Committee proposed that we should further improve the supervision mechanism and procedures for the implementation of the Constitution and raise the requirements for the implementation of the Constitution to a new level. The fourth Plenary session of the 18th CPC Central Committee further proposed to perfect the constitutional supervision system of the NPC and its standing Committee, to perfect the mechanism of constitutional interpretation procedures, to strengthen the record examination system and capacity-building, and to revoke and correct normative documents that violate the Constitution and violate the law according to law, and so on. Why should the CPC Central Committee propose to improve the constitutional supervision system of the NPC and its standing Committee? (I) Legislative supervision is the cornerstone of the construction of the rule of law and is at the core of the system of supervision of the rule of law.
