职业教育校企合作立法研究

【摘要】：作为我国三大教育形式之一，职业教育越来越多的受到国家和社会的重视。自发展以来，职业教育已经为国家培养了大批技术类应用型人才，大大缓解了我国生产一线相关人才紧缺的局面。目前，职业教育已发展成为一个与经济发展密切相关的教育类别，其中，作为其主要培养模式的校企合作发挥了很大的作用。我国职业教育校企合作的发展总体上呈现出地域范围广、发展规模庞大、涉及人数众多的特点，由于地域经济水平、教育经费投入、体制机制及观念意识等多种因素的综合影响，职业教育校企合作在全国范围内的发展并不均衡，存在着地域、发展层次等多方面的差别。在长期的实践摸索中，我国职业教育校企合作也出现了诸多问题，如校企合作各参与方角色不明、政府职责不清、师生权益维护等多种不同维度的问题，给职业教育校企合作的进一步深化带来不利影响。这些问题需要多种力量多种机制有机融合才能得到较好的解决，但法律作为最具权威性、最具普适性、最能有效规范相关行为的力量，是最不可或缺的。关于职业教育校企合作的各种文件目前我国已有很多，但涉及职业教育校企合作的法律规定却很少，有关的一般性规定基本都是框架性的指导和倡议性用语，表述笼统，缺乏具体可行的操作性，唯一一部专门性立法《宁波市职业教育校企合作促进条例》是地方性法规，虽其对我国职业教育校企合作中存在的诸多问题作出了规定，但因其效力范围仅限宁波市所辖区域，且因立法水平所限，结构编排较为混乱，也无法满足职业教育校企合作的实践发展需要，立法不足的现状造成了校企合作无章可循、无法可依的局面。本文通过分析我国职业教育校企合作的特点及其发展过程中存在的问题，从实践发展的角度论证了职业教育校企合作立法的必要性和紧迫性，同时，由于我国现有相关立法远远不足以满足和促进职业教育校企合作的实践发展，笔者针对我国职业教育校企合作中存在的各种问题，结合我国具体国情，并借鉴已有的成功立法经验，对有关我国职业教育校企合作的诸多事项，如调整对象、法律特征、体系建设、结构编排及重点立法内容等作了思考和讨论，表达了笔者自己的看法并提出相应立法建议，，希望能对我国职业教育校企合作立法进程起到一定推动作用。
[Abstract]:As one of the three major forms of education in China, vocational education is paid more and more attention by the country and society. Since its development, vocational education has trained a large number of technical applied talents for the country, which has greatly alleviated the shortage of related talents in our country. At present, vocational education has developed into a kind of education closely related to economic development, among which, the cooperation of school and enterprise, as its main training mode, has played a great role. On the whole, the development of the cooperation between colleges and enterprises in vocational education in China presents a wide range of regions, a large scale of development, and a large number of people involved. Due to the level of regional economy, education funds are invested. Because of the comprehensive influence of system mechanism and concept consciousness the development of the cooperation between school and enterprise in vocational education is not balanced in the whole country and there are many differences in region and level of development and so on. In the long-term practice, there are many problems in the cooperation between the school and the enterprise in vocational education in our country, such as the roles of the participants in the cooperation are not clear, the responsibilities of the government are not clear, the rights and interests of teachers and students are protected, and so on. The further deepening of the cooperation between schools and enterprises in vocational education has brought adverse effects. These problems need a combination of various forces and mechanisms in order to get a better solution, but the law is the most authoritative, the most universal, the most effective force to regulate the relevant behavior, is the most indispensable. At present, there are many documents on the cooperation between schools and enterprises in vocational education in our country, but there are few legal provisions concerning the cooperation between schools and enterprises in vocational education. The relevant general provisions are basically framework guidance and initiative terms, which are expressed in general terms. Lack of concrete and feasible operation, the only specialized legislation "Ningbo City Vocational Education School-to-Enterprise Cooperation Promotion regulations" is a local law, although it provides for many problems existing in the cooperation of vocational education schools and enterprises in our country. However, the scope of its effectiveness is limited to the areas under the jurisdiction of Ningbo City, and because of the limitation of the legislative level, the structure of the organization is relatively chaotic, and it is unable to meet the practical development needs of the cooperation of vocational education schools and enterprises. The current situation of insufficient legislation has resulted in the lack of rules for the cooperation between schools and enterprises. An impossible situation. Based on the analysis of the characteristics of school-enterprise cooperation in vocational education in China and the problems existing in its development, this paper demonstrates the necessity and urgency of the legislation of school-enterprise cooperation in vocational education from the perspective of practical development, and at the same time, Because the existing relevant legislation in our country is far from sufficient to meet and promote the practical development of the cooperation between vocational education schools and enterprises, the author aims at the various problems existing in the cooperation of vocational education schools and enterprises in our country, and combines the specific conditions of our country. Based on the successful legislative experience, this paper discusses many issues concerning the cooperation between schools and enterprises in vocational education in China, such as the object of adjustment, legal characteristics, system construction, structural arrangement and key legislative contents. The author expresses his own views and puts forward corresponding legislative suggestions, hoping to promote the legislative process of the cooperation between schools and enterprises in vocational education in China.
