【摘要】：为解决文化市场管理体制中存在的历史问题,从2004年起,党中央、国务院推行的文化市场综合执法改革试点由“点”到“面”开始在全国全面推行。全国大部分地区的文化(文物)、新闻出版广电(版权)所属的执法力量进行了归并,重新组建了文化市场综合执法机构。但是随着市场经济不断完善,蓬勃发展的文化市场推动着文化体制改革向纵深发展,新兴文化市场主体迅速崛起,迫切需要文化市场管理体制机制、管理方式的再次创新。而且市场准入制度等方面的改革也倒逼文化市场综合行政执法的改革。当前文化市场综合行政执法改革已进入“深水区”。因为各地文化市场发展水平不同,改革缺少一个自上而下的顶层设计,所以文化市场综合行政执法改革仍处于各地、各部门自己摸索阶段。本文针对宁波市文化市场综合行政执法深化改革的问题进行了研究,首先综述了文化市场综合行政执法相关基础理论,然后结合宁波市文化市场综合行政执法现状分析了当前宁波市文化市场综合行政执法工作中存在的问题,挖掘问题产生的原因,进而探寻宁波市文化市场综合行政执法深化改革的方法途径。由于文化市场行政执法研究往往从执法机制、模式改革开始的,一线执法经验正处于积累汇总的过程中,本文主要通过理论联系宁波市文化市场实际,从公共管理角度对文化市场综合行政执法工作作了一些探索,希望能为宁波市文化市场综合行政执法改革提供一些帮助。
[Abstract]:In order to solve the historical problems existing in the management system of the cultural market, since 2004, the pilot project of the comprehensive law enforcement reform of the cultural market carried out by the CPC Central Committee and the State Council has been carried out in an all-round way throughout the country from "points" to "facets". The law enforcement forces in most parts of the country (cultural relics, press, publication, radio and television (copyright) have been merged, and the comprehensive law enforcement agencies of the cultural market have been reorganized. However, with the continuous improvement of the market economy, the vigorous development of the cultural market promotes the reform of the cultural system to the depth, and the main body of the emerging cultural market rises rapidly, which urgently needs the management mechanism of the cultural market and the re-innovation of the management mode. And market-access system and other aspects of reform also forced the cultural market comprehensive administrative law enforcement reform. At present, the reform of comprehensive administrative law enforcement in cultural market has entered deep water area. Because the level of cultural market development is different, the reform lacks a top-down top-level design, so the comprehensive administrative law enforcement reform of the cultural market is still in various places, each department groping for itself. This paper studies the reform of the comprehensive administrative law enforcement in the cultural market of Ningbo. Firstly, it summarizes the basic theories of the comprehensive administrative law enforcement in the cultural market. Then combined with the current situation of comprehensive administrative law enforcement in Ningbo cultural market, the problems existing in the comprehensive administrative law enforcement work of Ningbo cultural market are analyzed, and the reasons for the problems are excavated. And then explore the Ningbo culture market comprehensive administrative law enforcement deepening the reform method. Since the research of administrative law enforcement in cultural market often starts from the reform of law enforcement mechanism and mode, the experience of law enforcement in the front line is in the process of accumulating and collecting. This paper mainly combines the theory with the practice of Ningbo cultural market. This paper probes into the comprehensive administrative law enforcement in the cultural market from the angle of public management and hopes to provide some help for the reform of the comprehensive administrative law enforcement in the cultural market in Ningbo.
