合作行政理论在我国食品质量监管的适用研究

【摘要】:对于当今的中国人,打开任何一个时间段的任何一款新闻节目,假冒伪劣甚至有毒有害的食品报道必定是其中一员。食品质量事故的一次又一次的发生,不断地冲击着中国民众的神经。我国食品质量事故似乎已成为肥皂剧般的固定套路:食品质量丑闻被媒体曝光,民众专家口诛笔伐,政府严肃处理,新的丑闻曝光。在这几近无限循环的食品质量案件中,民众的态度也慢慢的被磨得麻木,而民众对食品安全本身的关注,也逐渐向政府对食品质量监管上转移,因为一次次食品事故的发生不仅仅是对不良利益追逐者不法行为的曝光,更是对相关行政法规和政府在食品质量监管上的弊端的一次次揭露:法律法规及安全标准的不足和落后,政府对食品质量和安全的高调却低效的监管,公众参与被完全排除在监管体系之外。这样的背景下,不怪民众对自身食用安全愈加不信任甚至麻木,不怪政府公信力受到不断下降甚至丧失,更不怪专家民众对我国的食品安全质量监管体制的鄙夷。这凸显出现行食品质量的行政监管体系以及它背后的行政法学理论的许多问题。本文希望通过研究合作行政理论及其在食品监管上的适用,去革新我国的食品质量监管体制,以满足行政法发展和构建强有力的食品监管的需要。全文一共分四章: 第一章,合作行政理论一般分析。合作行政是一种需要在行政管制各个阶段都实行公私合作,以完成公共治理任务的新行政法理论。与传统行政法相比,合作行政一解决问题为中心思想和导向,改变政府和私人在行政立法、行政管制等行政行为中的关系和作用,以求实现公私双方在运行公权力和承担行政责任上的相互合作和相互监督。 第二章,从合作行政看我国食品质量监管现状。透过现象发现本质,站在合作行政理论的角度去分析,在我国食品质量监管的背后实质是失衡的公众参与决策管制、俘虏下的食品质量监管、专家理性的缺失和我国行政民主的缺乏。而正是这些内因造成了我国食品监管体制的诸多弊端。 第三章,将合作行政应用于我国食品质量监管的价值。合作行政的价值正是对现在食品质量监管缺失的最好回应:合作行政不仅可以推动行政法的发展,更可以推动民主化的行政、明确细化食品监管行政或民事责任以及建设良好的食品市场环境,并最终形成一个可以及时自我弥补和改进的食品监管体系。 第四章,关于合作行政应用于我国食品质量监管的建议。通过对英德两国的食品监管中社会参与的借鉴,提出将合作行政适用于食品监管法律体系的具体思路。在严格责任、信息透明和合作治理三原则的基础上,通过一系列法律和行政法规构建由政府为主导、以企业和市场为基础、充分发挥社会第三方力量并由调正范围更宽更灵活的行政诉讼保驾护航的新型食品质量监管体制。
[Abstract]:For today's Chinese, fake and even poisonous food reports must be part of any news program at any time. Food quality accidents occur time after time, constantly impacting the nerves of the Chinese people. Food quality accidents in China seem to have become a regular soap-opera routine: food quality scandals have been exposed in the media, experts have lambasted them, the government has dealt with them seriously, and new scandals have come to light. In this nearly infinite cycle of food quality cases, the attitude of the public has been slowly worn out, and the public's concern about food safety itself has gradually shifted to the government's supervision of food quality. Because food accidents happen again and again are not just the exposure of illegal behavior of bad interests pursuers. It also exposes again and again the shortcomings of the relevant administrative regulations and the government in the supervision of food quality: the insufficiency and backwardness of laws, regulations and safety standards, and the high profile but inefficient supervision of food quality and safety by the government, Public participation is completely excluded from the regulatory system. Against this background, it is not to blame the public for their food safety has become more distrust or even numbness, not to blame the government credibility has been declining or even losing, not to mention the contempt of the expert people to our food safety quality supervision system. This highlights the current administrative supervision system of food quality and many problems in the theory of administrative law behind it. This paper hopes to reform the food quality supervision system of our country by studying the cooperative administrative theory and its application in food supervision, in order to meet the needs of the development of administrative law and the construction of strong food supervision. The full text is divided into four chapters: The first chapter is the general analysis of cooperative administrative theory. Cooperative administration is a new theory of administrative law which needs to carry out public-private cooperation in every stage of administrative control in order to complete the task of public administration. Compared with the traditional administrative law, the cooperative administrative one solves the problem as the central idea and the direction, changes the government and the private in the administration legislation, the administrative control and so on administrative behavior relations and the function, In order to realize the mutual cooperation and mutual supervision of public power and administrative responsibility between public and private parties. The second chapter, from the cooperative administration to see the current situation of food quality supervision in China. From the perspective of cooperative administrative theory, the essence of food quality supervision in China is the unbalanced public participation in decision-making and the captive food quality supervision. Lack of expert rationality and lack of administrative democracy in China. And it is these internal causes that cause many malpractices of food supervision system in our country. In the third chapter, the cooperative administration is applied to the value of food quality supervision in China. The value of cooperative administration is the best response to the current lack of food quality supervision: cooperative administration can not only promote the development of administrative law, but also promote democratic administration. It is clear that the administrative or civil liability of food supervision should be refined and a good food market environment should be built, and finally a food supervision system which can make up for and improve itself in time is formed. The fourth chapter, about the cooperation administration application in our country food quality supervision suggestion. By drawing lessons from the social participation in the food supervision of England and Germany, this paper puts forward the concrete idea of applying cooperative administration to the legal system of food supervision. On the basis of the three principles of strict liability, information transparency and cooperative governance, through a series of laws and administrative regulations, the government is leading by the government, and it is based on enterprises and markets. Bring into full play the third party power of the society and the new food quality supervision system which is accompanied by a wider and more flexible administrative litigation.
