论我国政府信息公开制度存在的问题与改进途径

【摘要】:信息在现代社会生产生活中具有基础的原动力作用,很大程度上决定了一个社会的发展和进步,而公民如何获取信息、如何使用信息则充分表现出一个国家的现代化水平和国家治理追平。世界上率先建立信息公开制度的是瑞典,该国在1776年颁布的《公文书公开法》是世界上第一部成文的政府信息公开法律。以二十世纪经济危机和第二次世界大战爆发为第一个立法高潮,二十世纪九十年代随着信息技术和世界贸易的进一步发展,信息公开立法迎来了第二个高潮。我国的政府公开是随着我国改革开放逐渐发展起来的,到2008年5月1日开始实施我国的第一部成文的政府信息公开类法规—《中华人民共和国政府信息公开条例》。到现在,《条例》的实施已经有超过8年的时间,为我国的信息公开工作带来了巨大的推动作用,但是也发现了一些问题,比如:《条例》立法层级不高、规定不明确等,导致各个地方在理解和执行《条例》的过程中存在较大的差异,因此很难有效落实信息公开制度,进而保障公民的知情权。因此,本文从《条例》出发点,探讨现行制度存在的问题和可能采取的改进措施具有明显的现实意义。笔者从信息公开立法实际和自身工作的实际出发,从四个方面来探讨进一步完善我国信息公开制度建设的建议。第一部分从行政性、准确性和有限性三个方面介绍政府信息的概念,从而确定本文的研究对象问题,同时进一步阐述信息公开制度的理论渊源:人民主权理论和知情权理论,使得本文的研究有理有据;第二部分论述建立和完善政府信息公开制度的意义,进一步揭示本文研究所具有的的现实意义以及紧迫性;第三部分从立法层面、规定本身以及监督机制等方面对现行《条例》存在的问题进行深入剖析,为下一步提出完善建议指明方向;最后一部分提出完善我国信息公开制度的合理化建议,通过制定统一的《信息公开法》,明确信息公开的制度、内容和监管机制,使该项制度真正发挥应有的作用。
[Abstract]:Information plays a fundamental role in the production and life of modern society, and to a great extent determines the development and progress of a society, and how citizens obtain information. How to use information will fully show a country's modernization level and national governance level. Sweden is the first country to set up the open information system in the world. The publication of official documents Act issued by Sweden in 1776 is the first written government information disclosure law in the world. The first legislative climax was the outbreak of the economic crisis in the 20th century and the outbreak of the second World War. With the further development of information technology and world trade in the 1990s, the information disclosure legislation ushered in the second climax. With the gradual development of our country's reform and opening up, the first written government information disclosure regulation of the people's Republic of China (PRC) has been implemented since May 1, 2008. Up to now, the implementation of the regulations has been carried out for more than eight years, which has brought great impetus to the work of information disclosure in our country. However, it has also found some problems, such as: the legislative level is not high, the regulations are not clear, and so on. As a result, there are great differences in the process of understanding and implementing "regulations" in various places, so it is very difficult to effectively implement the information disclosure system, and then to protect the citizens' right to know. Therefore, from the point of view of "regulations", it is of great practical significance to discuss the problems existing in the current system and the possible improvement measures. Based on the practice of information publicity legislation and its own work, the author discusses the suggestions for further improving the construction of information disclosure system in China from four aspects. The first part introduces the concept of government information from three aspects of administration, accuracy and finiteness, so as to determine the research object of this paper. At the same time, it further expounds the theoretical origin of the information disclosure system: the theory of people's sovereignty and the theory of the right to know. The second part discusses the significance of establishing and perfecting the system of government information disclosure, and further reveals the practical significance and urgency of this study; the third part from the legislative level, The provisions themselves and the supervision mechanism thoroughly analyze the problems existing in the current regulations, and point out the direction for further improvement. The last part puts forward the rationalization proposals to improve the information disclosure system in our country. The system, content and supervision mechanism of information disclosure should be made clear by making a unified Law on Information publicity, so that the system can really play its due role.
