【摘要】:城镇住房制度的进一步改革和深化,促进了房地产业的繁荣发展。房地产开发企业为了满足市场需求,扩大融资渠道,于是商品房预售这种销售方式日渐成为商品房交易的主要方式。虽然,这种销售方式受到了市场的青睐,也为房地产市场的繁荣发展起到了积极的促进作用,但同时我们也看到在商品房销售市场繁荣的背后也暴露出许多问题,这就需要有相关法律制度来规范商品房预售行为,商品房预售法律规范的制定就显得尤为重要。我国的商品房预售制度是在1994年7月颁布的《中华人民共和国城市房地产管理法》中正式确立的。商品房预售制度的确立在初期对于商品房预售过程中的纠纷解决,法律适用都起到了直接的规范作用,一定程度上减少了交易纠纷,方便了司法实践中法官对相关法律条文的适用。但是房地产市场的不断发展,销售量的增加,新的纠纷类型的出现,导致现有的商品房预售法律制度难以全部涵盖,许多新型问题的解决缺乏法律依据。同时相关法律,法规大都较为概括,法律位阶较低,对于相关问题的法律规定只是在个别条款简单涉及,粗略规定。这些都体现出我国商品房预售法律制度的不健全。因此,本文的研究旨在通过对商品房的预售制度存在的各种法律问题进行分析,从中找出解决方案,以期进一步完善我国商品房预售的法律规制,促进房地产市场健康、有序、持续的发展。 本文在经济法的范畴内,利用提出问题,分析问题,解决问题的方法阐述了商品房预售法律制度的立法现状,指出了相关法律在解决商品房预售问题时存在的不足,在对这些问题进行综合分析的基础上,,进一步研究如何完善我国商品房预售法律制度,规范健全房地产市场。 商品房预售作为一种特殊的商品房交易方式,虽然其在增加房地产企业投资,减少购房者一次性支付房款的压力方面起到了不可忽视的作用,但我们要在保证其发挥积极作用的同时考虑到其引发的法律问题。本文的研究内容就是对我国商品房预售相关立法现状进行剖析,根据目前商品房预售过程中出现的法律纠纷来反思我国的商品房预售制度还有哪些方面不够完善。文中重点在于阐述我国商品房预售存在法律监管机制不完善、消费者权益保护制度缺失、预售资金监管不到位、法律责任承担不确定等一系列法律问题,然后根据具体问题提出完善商品房预售制度的建议。 本文中笔者在对我国现有商品房预售法律制度进行分析,最后得出结论认为我国商品房预售制度确实存在缺陷与不足,需要进一步完善才能更好的保障房地产市场的稳定发展。文中笔者结合我国实际情况,并且在借鉴国外成熟立法经验的基础上,提出关于商品房预售制度的完善的几点建议,主要的完善对策有加强对房地产开发企业的有效监管;重视对企业的资质和预售条件的实质审查;建立严格的信息公开机制保证购房者可以及时获得预售房屋的真实信息;明确预售资金的监管主体、监管职责、具体用途,确保预售资金的专款专用;严格审查和限制预售广告的发布,严厉惩处虚假宣传、夸大宣传等不良行为,保护购房者的合法权益。以上的几点建议只是作者在浅显研究后提出的一点拙见,期望通过对上述相关制度的完善和加强房地产行政部门监管的方式来规范我国商品房销售市场的交易秩序,保障购房者的合法权益。
[Abstract]:The further reform and deepening of the urban housing system has promoted the prosperity and development of the real estate industry. In order to meet the demand of the market, the real estate development enterprises expand the financing channels, so the sale mode of the commercial housing is becoming the main way of the commercial housing transaction. Although the sale mode has been favored by the market and the real estate market. The prosperity and development of the field has played a positive role in promoting, but at the same time, we also see that there are many problems behind the prosperity of the commercial housing market, which requires relevant legal systems to standardize the pre-sale behavior of commercial housing. The formulation of the legal norms of commercial housing pre sale appears particularly important. The system of commercial housing pre sale in China is in 1994. The establishment of the urban real estate management law of People's Republic of China, promulgated in July, was established. The establishment of the pre sale system of commercial housing was solved in the early stage of the commercial housing sale. The application of the law has played a direct and normative role, to a certain extent, reduced the transaction disputes and facilitated the judicial practice of the judges to the relevant laws. However, the continuous development of the real estate market, the increase of sales volume and the emergence of new types of disputes have resulted in the existing legal system for the pre-sale of commercial housing, and the lack of legal basis for the settlement of many new problems. The purpose of this study is to analyze the legal problems of the pre-sale system of the commercial housing, and to find out the solutions in order to further improve the legal regulation of the commercial housing advance sale in our country. Promote the healthy, orderly and sustainable development of the real estate market.
In the category of economic law, this paper expounds the legislative status of the legal system of commercial housing pre sale by means of raising questions, analyzing problems and solving problems, and points out the shortcomings of relevant laws in solving the problem of commercial housing pre sale. On the basis of comprehensive analysis of these problems, the paper further studies how to improve our commercial housing. The legal system is pre sold to standardize and improve the real estate market.
As a special way of commercial housing transaction, the pre sale of commodity house has played an important role in increasing the investment of the real estate enterprises and reducing the pressure on the one-time payment of the house payment by the buyers. However, we should take into account the legal problems caused by its positive role. The content of this paper is to me. According to the current legal disputes in the process of commercial housing pre sale, the present situation of the relevant legislation on commodity housing in China is analyzed. In this paper, what aspects of the commercial housing pre sale system in China are not perfect enough. The emphasis is on the lack of good legal supervision mechanism, the lack of the protection system of consumer rights and interests, the pre sale capital. There are a series of legal problems such as inadequate supervision of gold and uncertainty in legal liability. Then, suggestions for improving the pre-sale system of commercial housing are put forward based on specific problems.
In this paper, the author analyzes the legal system of the existing commercial housing pre sale in China, and finally draws a conclusion that the system of commercial housing pre sale in China does exist defects and deficiencies, and it needs further improvement to better ensure the stable development of the real estate market. On the basis of the test, it puts forward some suggestions on the improvement of the system of commercial housing pre sale. The main improvement measures are to strengthen the effective supervision of the real estate development enterprises, pay attention to the substantive examination of the qualifications and pre sale conditions of the enterprises, and establish a strict information disclosure mechanism to ensure the real information of the house buyers in time; Clear the subject of supervision, supervision responsibility, specific purpose, specific use, ensure special funds for pre sale funds, strictly review and restrict the release of pre sale advertising, severely punish false propaganda, exaggerate propaganda and other bad behavior, and protect the legitimate rights and interests of buyers. Through the improvement of the above related system and the strengthening of the supervision of the real estate administrative department, the order of the market of the commercial housing market in China is regulated and the legitimate rights and interests of the buyers are guaranteed.
