完善农业生产经营体系视野下家庭农场相关法律问题研究

【摘要】：文章通过对现有关于规范家庭农场发展的地方法规的文本进行分析,从家庭农场的主体属性、农场主的资格准入和家庭农场的资本三个角度展开研究,认为在主体属性方面,应当将家庭农场界定为家庭合伙;在成员准入方面,应当放开对农场主的资格限制,形成职业农民的自由准入机制;在家庭农场的资本方面,应当健全涉农资本的评估机制和体制,加大对农场主的保护,使其得以放心进行农业生产。
[Abstract]:Based on the analysis of the existing local laws and regulations on the development of family farms, this paper studies the main attributes of family farms, the qualification of farmers and the capital of family farms. Family farms should be defined as family partnerships; in terms of access to members, restrictions on the qualifications of farmers should be liberalized to form a mechanism of free access for professional farmers; and in the capital of family farms, The evaluation mechanism and system of agricultural capital should be improved, and farmers should be more protected so that they can carry out agricultural production safely.
